Percentile. If the Ninety-Fifth (95th) Percentile is a fraction of a megabit, it is rounded to the next full megabit and is compared to the CIR. If the Ninety-Fifth (95th) Percentile is greater than the CIR, Customer will, in addition to being billed for the CIR as described in (b) above, be billed for the difference between the CIR and the Ninety-Fifth (95th) Percentile and such difference shall be billed at the price per megabit described in the Agreement multiplied by the number of megabits. The Burstable Service is available on a best efforts basis only. The ability to burst is subject to availability and is limited to the burstable limits set forth in the Agreement.

Without a subscript, "MaxCMT" refers to all CM intervals. Example, "MaxCMT(Dn)" refers to CMT(Dn) intervals. • Level of Maintenance. Indicated by letters in parentheses after CMT. Percentile. XcellHost will collect the sample of bandwidth used in defined time intervals (in five (5) minute intervals) for both inbound and outbound traffic. The top 5% of the sample size of the total sample size over calendar month is removed. The next highest sample after the removal of top 5% is the 95th percentile sample for the month. The highest 95th percentile sample between inbound and outbound samples is considered the sustained usage level for billing purpose.

After determining the Company’s rank, the Company’s “percentile” will be calculated as follows: P=1-R-1N-1 where: “P” represents the percentile which will be rounded, if necessary, to the nearest whole percentile by application of regular rounding. “N” represents the total number of entities in the Comparison Group (including the Company, but after removal of any entities in accordance with the calculation of the rank).

Percentile. Upon such determination by the Committee and subject to the provisions of the Plan and this Agreement, the Grantee shall be entitled to a number of Restricted Shares equal to the number that is determined pursuant to this Section 3(b).
