Perform and Observe All Covenants. The Permitted Mortgagee shall, subject to the provisions of Section 8.9(a) and (b), perform and observe all covenants in this Agreement to be performed and observed by a Permitted Mortgagee and failure to do so shall, after notice and opportunity to cure, be a Developer Event of Default under this Agreement.
