Common use of Permanently Incapacitated Clause in Contracts

Permanently Incapacitated. Executive shall be deemed Permanently Incapacitated in the event that the Company determines, after reasonable and appropriate consultation with appropriate medical personnel, by reason of his physical, mental or other medical condition, Executive is and has been unable to perform the essential functions of his duties and responsibilities for the Company with or without reasonable accommodation, for a period of 100 consecutive days or 120 days in the aggregate in any twelve (12) month period, unless another longer period is otherwise required by law.
