Perpetual Rights. Where Licensed Material includes BMJ journals content (but excluding case reports), BMJ grants to the Subscriber, a non-exclusive, royalty-free licence to permit Authorised Users to access in perpetuity those BMJ journal articles included in the Licensed Material which are published during the Subscription Term. The means by which the Subscriber shall have such perpetual access shall be in a manner determined by BMJ, but shall be in electronic form. Where any Licensed Material for which perpetual access is granted is sold or where BMJ no longer retains the rights to such material, BMJ shall use its reasonable efforts to ensure that the purchaser or subsequent holder of the rights (as the case may be) will provide ongoing access to the affected articles. Perpetual rights shall not extend to any Licensed Material that is not a BMJ journal or any portion of journal material that has been expunged from the archive, removed pursuant to clause 4 above, damaged or sold. Should any back issues (or archival content) of any journal be accessible to Authorised Users during the Term, these shall not be part of the Subscriber’s perpetual access rights.
Perpetual Rights. Neither the Authority nor the Sponsor shall be required to delete or supress any Below the Line Activity after the end of the Promotion Periods. The Authority acknowledges that from time to time the Sponsor may create campaign retrospectives, special anniversary campaigns or documentaries and “making of” or “behind the marketing campaigns. Sponsor shall be entitled to reuse the bespoke Folding themed Old Street Roundel; and video, images and depictions of this in situ during the Activations for such purposes, without further recourse to the Authority provided Sponsor uses materials that were approved by Sponsor for the purposes of this Project.
Perpetual Rights. Notwithstanding anything else in this Agreement, Licensor hereby grants to Licensee a nonexclusive, royalty- free, perpetual license to use any Licensed Materials that were accessible during the term of this Agreement. Such use shall be in accordance with the provisions of this Agreement, which provisions shall survive any termination of this Agreement. The means by which Licensee shall have access to such Licensed Materials shall be in a manner and form substantially equivalent to the means by which access is provided under this Agreement.
Perpetual Rights. Where a subscription to any Core or Non-Core Subscription published during the Subscription Period and purchased by the Licensee expires or is otherwise terminated other than as a result of a breach of this Agreement by the Licensee, then the Publisher shall for the purposes of the long term preservation of the materials forming part of any such Subscription either (at its sole option and at any time):
9.5.1 continue to provide access to the Licensed Materials comprising such Subscription, either via the Online Services or by way of the online services of a third party provider; or
9.5.2 provide or arrange for a third party to provide the Licensee with a copy of the Licensed Materials comprising such Subscription in a secure digital or electronic format determined by the Publisher or such third party, subject always to the right of the Publisher to withdraw from the Licensee any access to any Licensed Materials in the event that for any reason the Publisher ceases to have the right to grant such access, and subject further to the right of the Publisher or any relevant third party provider to apply additional terms and conditions on such access including requiring the Licensee to bear any charges reasonably incurred by the Publisher or such third party in continuing to provide such access. The Licensee must ensure it and any Authorised User continues to comply at all times with the permitted use and restrictions set out herein and with Licensee’s undertakings with respect to the Licensed Materials, which provisions will survive termination of this Agreement. The Publisher shall have no obligation to provide an electronic copy or maintain the Online Services in relation (i) to any Licensed Content or (ii) to any Licensed Materials where access has been terminated as a result of the Licensee’s breach of this Agreement. For the avoidance of doubt the Publisher shall not be required to digitise any Licensed Materials in order to give effect to this Clause 9.5, and the provisions of this Clause 9.5 shall not apply to any Licensed Content.
Perpetual Rights. 1. P erpetual License. Notwithstanding anything else in the Agreement, Licensor grants to Licensee and Participating Institutions a nonexclusive, royalty-free, system-wide perpetual license limited to the territory of Czech Republic to use any Licensed Materials that were subscribed to or for which a perpetual license fee has been paid during the term of this Agreement. Such use shall be in accordance with the provisions of this Agreement, which provisions shall survive any termination of this Agreement. If the Licensor’s means of access is not available, the Licensee and/or Participating Institutions may provide substantially equivalent access to the Licensed Materials by engaging the services of third-party trusted archives (such as Portico) and/or participating in collaborative archiving endeavors to exercise its perpetual use rights.
Perpetual Rights. 3.1 Licensee’s will have perpetual rights to all of the Imagery Products and Heights Products providing that on the expiry date of the contract they: Have continuously held a Member License for longer than one year before contract expiry.
3.2 Perpetual Rights will be provided for all the data sets.
3.3 For the purposes of clarity, perpetual rights will not be provided to the following services WMS and WFS services beyond the expiry of this agreement.
3.4 The Licensee recognises that all of the restrictions on usage contained in this Member License (including but not limited to business use, Public Sector Use, release of derived data, Contractor Licenses, INSPIRE End Users and Innovation Licenses) shall continue in force in perpetuity beyond 31st March 2020.
Perpetual Rights. For the avoidance of doubt, any perpetual licenses granted under this Agreement in respect of intellectual property rights, which may subsist indefinitely, shall extend for a period of thirty (30) years.

Sponsor shall be entitled to reuse the bespoke symbols and other imagery; and video, images and depictions of them in situ during the Activations for such purposes in perpetuity, without further recourse to the Authority provided Sponsor uses materials that were approved by Sponsor for the purposes of this Project.
Perpetual Rights. Neither the Authority nor the Sponsor shall be required to delete or supress any Below the Line Activity after the end of the Sponsorship Period. The Authority acknowledges that from time to time the Sponsor issues campaign retrospectives, special anniversary campaigns or documentaries and “making of” or “behind the scenes” views of iconic PlayStation console and game launches and marketing campaigns. Perpetual Rights. Note: This article applies only to the Licensed Materials which are perpetual, so it is obligatory only for e-journals and e-books with permanent license – in contrast to factual, citation or similar databases and e-resources.
