Perpetual Rights. Where Licensed Material includes BMJ journals content (but excluding case reports), BMJ grants to the Subscriber, a non-exclusive, royalty-free licence to permit Authorised Users to access in perpetuity those BMJ journal articles included in the Licensed Material which are published during the Subscription Term. The means by which the Subscriber shall have such perpetual access shall be in a manner determined by BMJ, but shall be in electronic form. Where any Licensed Material for which perpetual access is granted is sold or where BMJ no longer retains the rights to such material, BMJ shall use its reasonable efforts to ensure that the purchaser or subsequent holder of the rights (as the case may be) will provide ongoing access to the affected articles. Perpetual rights shall not extend to any Licensed Material that is not a BMJ journal or any portion of journal material that has been expunged from the archive, removed pursuant to clause 4 above, damaged or sold. Should any back issues (or archival content) of any journal be accessible to Authorised Users during the Term, these shall not be part of the Subscriber’s perpetual access rights.

Perpetual Rights. Notwithstanding anything else in this Agreement, Licensor hereby grants to Licensee a nonexclusive, royalty- free, perpetual license to use any Licensed Materials that were accessible during the term of this Agreement. Such use shall be in accordance with the provisions of this Agreement, which provisions shall survive any termination of this Agreement. The means by which Licensee shall have access to such Licensed Materials shall be in a manner and form substantially equivalent to the means by which access is provided under this Agreement.
Perpetual Rights. Note: This article applies only to the Licensed Materials which are perpetual, so it is obligatory only for e-journals and e-books with permanent license – in contrast to factual, citation or similar databases and e-resources.

The means by which Licensee shall have access to such Licensed Materials shall be in a manner and form substantially equivalent to the means by which access is provided under this Agreement. lf the Licensor's means of access is not available, the Licensee may provide substantially equivalent access to the Licensed Materials by use of an archival copy or by engaging the services of third-party trusted archives (such as CLOCKSS or Portico) and/or participating in collaborative archiving endeavors to exercise its perpetua! use rights. Archival Copy. Licensor shall provide to Licensee upon request one (1) digital copy of the entire set of Licensed Materials to be maintained as an archival copy. The archival copy from the Licensor shall be provided in a mutually agreeable medium suitable to the content, and any fees for provision of copies will be on a time and materials basis only. ln the event the Licensor discontinues or suspends selling or licensing the Licensed Materials, the Licensee may use such archived Licensed Materials under the same terms as this Agreement. lf Licensee has a backup copy of the Licensed Materials as defined in Section IV, the backup copy may be used as an archival copy.

Perpetual Rights. For the avoidance of doubt, any perpetual licenses granted under this Agreement in respect of intellectual property rights, which may subsist indefinitely, shall extend for a period of thirty (30) years.
