This recommendation aims to enter into a Settlement Agreement for Avigation Easement for runway 23 at Xxxxx Xxxxxxxx airport with Short Realty Company, Inc located at 000 Xxxxx Xxxxx Xxxx, Xxx Xxxx, Xxxxxxxx. The intent of this easement is to maintain a clear, unobstructed approach to the Xxxxx Xxxxxxxx Airport, and obstruction removal will be required. Upon execution of this easement, the grantee shall be eligible for federal funding to remove all-natural growth (trees and shrubs that are existing penetrations or have the potential to be obstructions in the future) from the easement property and return the area where vegetation is removed to a clear state after execution of this agreement. Over the last several years, trees have grown and infringed on the air space and runway protection zone (RPZ protection) of Runway 5/23. These infringements pose an inherent risk to pilots, and this easement will provide relief and the ability to remove any obstructions. Additionally, the presence of these trees required the navigational aids on the Runway 23 approach to be turned off and rendered unusable by the pilots landing on Runway 23. Avigation Easement (MDOT Aeronautics) Description: Avigation Easements are property rights acquired by an airport whenever land use around an airport needs to be controlled (RPZ protection) or when air rights and/or obstruction removal (for example, a tree) is required. Additionally, I am seeking authorization to allow the City Manager and City Attorney to execute the agreement on behalf of the City.

City Staff and Bird are asking for approval of an agreement for 2022 with Bird Rides, Inc, to modernize and diversify the way residents and visitors move about the City. This agreement will allow the deployment of stand-up electric scooters in Bay City once again in the City limits. This agreement will automatically renew each year and opt-out language has been added. The way people get from place to place, known as mobility, is vastly changing within cities. One particular advancement is electronically powered stand-up scooters known as e-scooters. While e-scooters are already allowed within the City of Bay City under the Michigan Vehicle Code (and many residents privately own scooters), this shared system includes many e-scooters, owned by a single company, which will be managed by a contract fleet manager to balance the system daily, as well as charge the e-scooters. To use the e-scooters, riders must download the app via a smartphone and create an account to pay for the ride. Rules, which are similar to those using a bicycle, must be followed by the rider. We will also work with the vendor to produce a map where the e-scooters will be programed to travel in the city. For example, we would not allow birds to be on the rail trail. Bird works with staff well on setting speed limit restrictions and changing requirements such as licenses, etc, to ride a Bird. 200 Birds landed on July 3, 2021, with thousands of rides and miles traveled throughout our city through December 31, 2021.
