Common use of PLANNING CONDITIONS Clause in Contracts

PLANNING CONDITIONS. 9.1 The Buyer acknowledges that the Planning and Land Authority is responsible for all statutory development consents and approvals sought by or on behalf of the Buyer in relation to the Land and the Buyer therefore releases the Seller and Development Manager from any liability, cause of action or any other claim in relation to disturbance, loss or detriment caused by the Planning and Land Authority granting, with or without conditions, or denying any consent or approval in relation to the Land. 9.2 The Buyer acknowledges the obligation to make the Buyer’s own enquiries and to satisfy itself as to the currency and accuracy of information contained in the Territory Plan. 9.3 The Buyer acknowledges that the Planning and Land Authority is responsible for the Territory Plan and the Buyer will make no claim against the Seller whatsoever in this regard. 9.4 The Buyer acknowledges that nothing in this Contract (including the Housing Design Requirements) or the fact of Completion implies or means that any required approvals, consents or licences regarding planning, design, siting and any other matters relating to the Buyer’s development of the Land will be granted by the regulatory authorities or other agencies of the Australian Capital Territory with or without conditions.
