Possessory Lien. The CITY shall be entitled to a possessory lien on said boat for any and all monies owned by the PERMITTEE to the CITY for said slip, storage, work performed, services rendered and materials furnished to the PERMITTEE or his/her boat.
Possessory Lien. When may be exercised:
1. Where the goods have been sold without any stipulation as to credit
2. When the goods have been sold on credit, but the term of credit has expired
Possessory Lien. Company shall have a possessory lien against Customer tooling and/or molded parts and/or materials as security for the failure of the Customer to pay any balance due the Company for any invoiced tooling, molded parts or specially purchased materials.
Possessory Lien. The Supplier has a possessory lien over the Goods and other property of the Applicant in its possession or under its control from time to time with respect to any Charges due from the Applicant or other person to the Supplier under this Agreement. The Supplier may sell the Goods and apply the proceeds to pay Charges due after providing written notice to the Applicant's last known place of business or registered office of its intention to do so.
Possessory Lien. As additional security for the payment and performance of the Obligations, each Debtor hereby pledges to Secured Party, and grants to Secured Party, a continuing security interest in, Lien upon and right of setoff against, all right, title and interest of Debtor in an to all property (including cash and securities) and the proceeds thereof, which shall come into Secured Party's possession, custody or control for any purpose or which shall be in transit to Secured Party to or for the account of such Debtor, including, without limitation, for safekeeping, custody, pledge, transmission, collection or otherwise, and in and to credits of such Debtor with Secured Party, and any and all other claims, rights and demands of Debtor against Secured Party, now or at any time hereafter existing. Upon the occurrence of an Event of Default which is continuing, and at any time and from time to time thereafter so long as the Event of Default is continuing, Secured Party is hereby expressly authorized, without notice to Debtor, to setoff, appropriate and apply any and all of the items described above to payment of all or any of the obligations, in such order as Secured Party in its sole discretion shall determine.
Possessory Lien. 14.1 Rivimetal shall have a possessory lien against goods as security for the failure of the Buyer to pay any balance due Rivimetal for invoiced goods.
Possessory Lien. By execution of this Agreement, Vessel Owner acknowledges that pursuant to Harbors and Navigation Code Sections 491, 501 and/or the Federal Maritime Lien Act (46 U.S.C. Sections 31301 et seq.) and by the terms of this Agreement, City shall have a lien on the Vessel for money, which may become due under this Agreement. Pursuant to said statutory lien and the terms of this Agreement, City has the right to take possession and control of the Vessel, secure the Vessel to the Slip, remove the Vessel from the Slip, and/or store the Vessel at a location of the City’s choosing. So long as City continues to hold the Vessel, Vessel Owner shall be deemed to be responsible for all continuing charges and expenses.
Possessory Lien. In the event of default in payment, or breach of any other condition of this license agreement, or for any and all damages caused to the property of the County by Licensee, it agents, employees or invitees, the County shall have a possessory lien upon any and all property stored, used or located on any property of the County and upon any sums of money advanced to or otherwise in the possession of the County.
Possessory Lien. Centurion has a possessory lien over the Goods and any other property of the Customer or documents relating thereto in its actual or constructive possession or control from time to time with respect to any Charges due from the Customer to Centurion under this or any other Agreement, including the exercise by Centurion of any rights or remedies under this Agreement. Centurion may sell the Goods by public auction or private treaty at the Customer’s risk and expense and apply the proceeds to pay any Charges due, after providing at least 15 days’ written notice to the Customer’s last known place of business or registered office of its intention to do so. In the event that any such sale proceeds are insufficient to pay all Charges due, Centurion retains the right to recover any balance of unpaid Charges.
Possessory Lien. The mechanic may exert a possessory lien on the cycle, if and as long as: • the client has not paid the cost of the work activities performed on the cycle, or has not paid them in full; • the client has not paid the cost of previous work activities performed by the mechanic on the same cycle, or has not paid them in full; • The client has not paid other claims under the contractual relationship with the mechanic/seller, or has not paid them in full. The mechanic cannot exercise the possessory lien if the client has furnished sufficient or additional alternative security. WARRANTY
