Common use of Pre-Participation Years Clause in Contracts

Pre-Participation Years. In applying Section 4.3, a year shall be taken into account only if (i) the Participant was eligible to participate in the Plan during all or a portion of the year and (ii) salary and wages, if any, under the Plan during the year was subject to the Basic Annual Limitation described in Section 4.1 or any other plan ceiling required by Section 457(b) of the Code.

In applying Section 4.34.03, a year shall be taken into account only if if (i1) the Participant was eligible to participate in the Plan during all or a portion of the year and (ii2) salary and wagesCompensation deferred, if any, under the Plan during the year was subject to the Basic Annual Limitation described in Section 4.1 4.01 or any other plan ceiling required by Section section 457(b) of the Code.
