PREMIUM SHIPMENTS. If Seller fails to have goods ready for shipment in time to meet Xxxxx’s delivery schedules using the method of transportation originally specified by Buyer and, as a result, Buyer requires Seller to ship the goods using a premium (more expeditious) method of transportation, Seller will ship the goods as expeditiously as possible. Seller will pay, and be responsible for, the entire cost of such premium shipment, unless Xxxxx’s actions caused Seller to fail to meet Xxxxx’s delivery schedules, in which case Buyer will pay any costs for premium shipment.

PREMIUM SHIPMENTS. If Seller’s acts or omissions result in Seller’s failure to meet Xxxxx’s delivery requirements and Buyer requires a more expeditious method of transportation for the goods than the transportation method originally specified by Xxxxx, Seller shall ship the goods as expeditiously as possible at Seller’s sole expense.
PREMIUM SHIPMENTS. If Seller's acts or omissions result in Seller's failure to meet Buyer's delivery requirements and Buyer requires a more expeditious method of transportation for the goods than the transportation method originally specified by Buyer, Seller shall, at Buyer's action: (i) promptly reimburse Buyer the difference in cost between the more expeditious method and the original method; (ii) allow Buyer to reduce its payment of Seller's invoices by such difference, or (iii) ship the goods as expeditiously as possible at Seller's expense and invoice Buyer for the amount which Buyer would have paid for normal shipment.
PREMIUM SHIPMENTS. If Seller fails for any reason, other than Buyer’s failure to fulfill its obligations under this Agreement, to have Goods ready for shipment in time to meet Buyer's delivery schedules using the method of transportation originally specified or utilized by Buyer, Buyer will have the right to either arrange for shipment of the Goods or require Seller to ship the Goods, in each case using a premium (more expeditious) method of transportation, and Seller will pay or reimburse Buyer for the entire cost of such premium shipment.
PREMIUM SHIPMENTS. If, for any reason, Seller is unable to meet Buyer’s delivery requirements, Seller shall immediately notify Buyer of its expected duration of the delay and the reasons for such delay. Neither such notification nor an acknowledgement by Buyer shall constitute a waiver of the applicable delivery schedule or any of Buyer’s rights under the Agreement. If Buyer requires more expeditious method of transportation for the Goods other than the transportation method originally specified by Buyer because of Seller’s failure or inability to meet the specified delivery schedule, Seller shall, at Buyer’s option, (a) promptly reimburse Buyer the difference in cost which may be incurred by Buyer between the more expeditious method and the original method, (b) allow Buyer to reduce its payment of Seller’s invoices by such difference, (c) ship the goods as expeditiously as possible at Seller’s expense and invoice Buyer for the amount which Buyer would have paid for normal shipment. Seller shall also be liable for any direct and/or consequential damages incurred by Buyer resulting from any delay caused by Seller. Premium freight must be so noted on shipping documents.

PREMIUM SHIPMENTS. If SUPPLIER fails to have Products ready for shipment in time to meet Mobileye’s delivery schedules using the method of transportation originally specified by Mobileye and, as a result, SUPPLIER shall ship the Products using a premium (more expeditious) method of transportation, SUPPLIER will bear entirely the extra cost of, and be responsible for the premium shipping method, unless the delay is caused by specific event which is caused due to Force Majeure event or shortages of Components delivered by Mobileye to SUPPLIER’s specified warehouse in Hong Kong (only in the event there is direct, responsibility of Mobileye for the delay)

In any other event, Xxxxxx agrees not to charge any premium unless approved in writing by Buyer prior to the shipment of the goods.
