Common use of Prize Clause in Contracts

Prize. a. One (1) Entrant will be selected via a random drawing to win a $250.00 “Mastermind Room Escape” gift card to use with their respective OPTAVIA “team” during Convention (the “Prize”). b. Prize Winner agrees to indemnify, release, and hold harmless the Sponsor, OPTAVIA, and its respective parents, affiliates and subsidiary companies, advertising and promotional agencies, and all their respective officers, directors, employees, representatives and agents from any liability, damages, losses or injury (including, without limitation, direct, indirect, incidental, special, consequential or exemplary damages) arising in tort (including negligence, whether active, passive or imputed) caused in whole or in part as a result of the Giveaway, including, but not limited to, the Entrant’s acceptance of any Prize in association with this Giveaway. c. The Prize must be taken as offered and may not be assigned or transferred. The Prize is valued in U.S. dollars. The Sponsor accepts no responsibility for any variation in the Prize value. Sponsor reserves the right, in its sole discretion, to substitute a Prize of equal or greater value. d. Incidental expenses and all other costs and expenses which are not specifically listed as part of the Prize in these official rules and which may be associated with the Prize acceptance, receipt and use of all or any portion of the awarded Prize are solely the responsibility of the Winner. e. ALL FEDERAL, STATE AND LOCAL TAXES ASSOCIATED WITH THE RECEIPT OR USE OF ANY PRIZE ARE THE SOLE RESPONSIBILITY OF THE WINNER AND WILL BE BASED ON THE ACTUAL RETAIL VALUE OF THE PRIZE. f. Except for the Prize value, Giveaway Winner will not receive any additional compensation or acknowledgement for entry in the Giveaway. g. If Prize Winner is unable to use the Prize, for any reason, the Winner forfeits the Prize and no substitute Prize will be given. Sponsor, at its sole discretion, will determine if the Prize may be awarded to another Winner selected at random.

Prize. a. One All Entrants in the Giveaway will automatically receive “Priority Access” to the OPTAVIA Convention room block (1Opening Fall 2019). In addition: i. Five (5) Entrant Entrants will be randomly selected via a random drawing to win a $250.00 “Mastermind Room Escape” gift card 100.00 Delta Airlines Gift Card. ii. Seventy-five (75) Entrants will be randomly selected to use with receive reserved seating for the Entrant Coach and their respective OPTAVIA “team” during (eight (8) total reserved seats per selected Entrant) at the Opening General Session of OPTAVIA Convention (the “Prize”)2020 on Thursday, July 23, 2020. b. The Prize Winner will be able to select either prize and size preference. b. The Prize Winner agrees to indemnify, release, and hold harmless the Sponsor, OPTAVIA, LLC, and its respective parents, affiliates and subsidiary companies, advertising and promotional agencies, and all their respective officers, directors, employees, representatives and agents from any liability, damages, losses or injury (including, without limitation, direct, indirect, incidental, special, consequential or exemplary damages) arising in tort (including negligence, whether active, passive or imputed) caused in whole or in part as a result of the Giveaway, including, but not limited to, the Entrant’s acceptance of any Prize in association with this Giveaway. c. The Prize Winner agrees to indemnify, release, and hold harmless the Sponsor, OPTAVIA, and its respective parents, affiliates and subsidiary companies, advertising and promotional agencies, and all their respective officers, directors, employees, representatives and agents from any liability, damages, losses or injury (including, without limitation, direct, indirect, incidental, special, consequential or exemplary damages) arising in tort (including negligence, whether active, passive or imputed) caused in whole or in part as a result of the Giveaway, including, but not limited to, the Entrant’s acceptance of any Prize in association with this Giveaway. c.
