i. BPRD and OSU-C may participate in the scoring of proposals, and will be notified by the City’s Procurement Director, Xxxx Xxxxxxx, at xxxxxxxx@xxxxxxxxxx.xxx, no less than three business days prior to the scheduled scoring dates.
ii. If at least one proposal, that is responsive and from a responsible proposer meeting all public contracting requirements, is received that provides a total cost for designing and constructing both the Colorado-Columbia Roundabout and Xxxxxxx-Columbia Roundabout for less than $5,700,000, the City will score based on proposals for both roundabouts, and proceed as follows:
1. If the total cost in any proposal is $4,800,000 or less, the City will score proposals and proceed with a contract for design and construction of both the Columbia-Colorado Roundabout and Xxxxxxx-Columbia Roundabout.
2. If the total cost in any proposal is between $4,800,000.01, and $5,700,000, the City will score the proposals and the Parties will meet to discuss funding and cost sharing. Only if the Parties agree on cost-splitting as described in Section 3 will the City proceed with a single contract for the Colorado- Columbia Roundabout and Xxxxxxx-Columbia Roundabout.
3. If the Parties are unable to agree on cost-splitting for the Xxxxxxx-Columbia Roundabout as described in Section 3, and the Selected Response provides a cost for the Colorado- Columbia Roundabout for $2,700,000 or less, the City will proceed with a contract for the design and construction of the Colorado-Columbia Roundabout alone, and BPRD will have no further obligation under this Agreement. Termination of BPRD’s obligations under this Agreement shall have no effect on BPRD’s obligations to construct the Xxxxxxx-Columbia Roundabout under Ordinance 2224.
