Procurement and Construction. Engineering, Procurement and Construction (EPC) activities within the scope include design, material procurement, and construction required for the Demonstration Cascade. EPC may also maintain the required management, engineering, procurement, construction, and industrial base to support timely transition to the commercial plant, through design advancement, and other related activities.
Procurement and Construction a. The City will issue a request for proposals (RFP) for a design-build contract for the design and construction of the Colorado-Columbia Roundabout, with the ▇▇▇▇▇▇▇-Columbia Roundabout as an additional, optional project. The City, as the contracting agency will score the RFP responses and select a design-builder (the “Selected Response”), in accordance with all applicable provisions of the Oregon Public Contracting Code, ORS chapters 279, 279A, 279B, and 279C, the Oregon Administrative Rules for public procurement, and Bend Code chapter 1.50, and as described in this Section 4.a.
i. BPRD and OSU-C may participate in the scoring of proposals, and will be notified by the City’s Procurement Director, ▇▇▇▇ ▇▇▇▇▇▇▇, at ▇▇▇▇▇▇▇▇@▇▇▇▇▇▇▇▇▇▇.▇▇▇, no less than three business days prior to the scheduled scoring dates.
ii. If at least one proposal, that is responsive and from a responsible proposer meeting all public contracting requirements, is received that provides a total cost for designing and constructing both the Colorado-Columbia Roundabout and ▇▇▇▇▇▇▇-Columbia Roundabout for less than $5,700,000, the City will score based on proposals for both roundabouts, and proceed as follows:
1. If the total cost in any proposal is $4,800,000 or less, the City will score proposals and proceed with a contract for design and construction of both the Columbia-Colorado Roundabout and ▇▇▇▇▇▇▇-Columbia Roundabout.
2. If the total cost in any proposal is between $4,800,000.01, and $5,700,000, the City will score the proposals and the Parties will meet to discuss funding and cost sharing. Only if the Parties agree on cost-splitting as described in Section 3 will the City proceed with a single contract for the Colorado- Columbia Roundabout and ▇▇▇▇▇▇▇-Columbia Roundabout.
3. If the Parties are unable to agree on cost-splitting for the ▇▇▇▇▇▇▇-Columbia Roundabout as described in Section 3, and the Selected Response provides a cost for the Colorado- Columbia Roundabout for $2,700,000 or less, the City will proceed with a contract for the design and construction of the Colorado-Columbia Roundabout alone, and BPRD will have no further obligation under this Agreement. Termination of BPRD’s obligations under this Agreement shall have no effect on BPRD’s obligations to construct the ▇▇▇▇▇▇▇-Columbia Roundabout under Ordinance 2224.

Procurement and Construction. 1. Grantee will comply with the applicable Departmental Regulations procurement requirements including but not limited to standards of conduct, open and free competition, access to contractor records, and equal employment opportunity requirements.

Procurement and Construction. The procurement process and contract award for all goods and services shall be in compliance with 2 CFR Parts 184 and 200 and all regulations applicable to CDBG funding and this Agreement. In the event specifications for goods, services and or construction activities are required, the following shall apply:
(1) The bid process shall not allow for any local procurement preferences with regard to contract award:
a. b. Prior to issue of the advertisement for bid, DHED may request that the Subrecipient submits to DHED a copy of the bid document package for review to determine compliance with 2 CFR Parts 184 and 200 and all regulations applicable to CDBG funding and this Agreement.
c. Following the bid process, the Subrecipient shall submit a copy of bid package to DHED including any addendums, documentation regarding any protests filed regarding the bids, a notice of contract award and a copy of the executed construction contract.
d. Prior to the Subrecipient’s first reimbursement, DHED shall review the Subrecipient’s bid process and contract award to determine compliance with all regulations applicable to CDBG funding and this Agreement.
(2) Should the Subrecipient use a brand name or multiple brand names in its bid package/drawings/ specifications for this project, then these documents shall:
(a) Clearly note that specified brand name(s) are used for descriptive purposes only,
(b) State that “approved equal” equipment or materials may be accepted, and
(c) Identify the minimum requirements to establish equality.
(3) The Subrecipient shall prioritize the work in the project, and shall bid such work in a manner that requires the receipt of itemized costs from bidders. This would then allow the award of items that can be funded by the budget provided that the extent of work awarded will result in a functioning facility in the opinion of DHED.
(4) The Subrecipient shall not award the construction contract for the project until sufficient funding is available to complete the established scope of work.
