Professional Judgment. Recognizing the board’s authority to select materials, programs, and strategies for use in the classroom, teachers will exercise professional judgment in determining when and how to modify, supplement, or create lessons and assessments to meet the needs of students and to achieve unit and lesson objectives.
Professional Judgment. Each of the parties acknowledges and agrees that the terms and conditions of this Agreement pertain to and control the business and financial relationship between and among the parties but do not pertain to and do not control the professional and clinical relationship between and among ROAII, Physician Employees, ROAII Employees, and ROAII's patients. Nothing in this Agreement shall be construed to alter or in any way affect the legal, ethical, and professional relationship between and among ROAII, Physician Owners, Physician Employees, and ROAII's patients, nor shall anything contained in this Agreement abrogate any right, privilege, or obligation arising out of or applicable to the physician-patient relationship.
Professional Judgment. Nothing in this Agreement shall prohibit PHARMACY’s pharmacists from exercising professional judgment in the dispensing of Covered Prescription Services and such pharmacists may refuse to dispense any Covered Drug based upon their professional judgment.
Professional Judgment. Consultant intends to serve as the SDSTA’s professional representative for those services as defined in this agreement and to provide advice and consultation to the SDSTA as a professional exercising the same degree of care and skill as would be exercised by others in the same profession in South Dakota. Any opinions of probable project cost, approvals, and other decisions made by Consultant for the SDSTA are rendered on the basis of experience and qualifications and represent Consultant’s professional judgment.
Professional Judgment. The parties agree that Unit 16 employees shall not practice, nor shall they be required to practice, in any manner which places their professional license(s) in jeopardy. Professional judgment issues may be appealed to the third step of the grievance and arbitration procedure in this contract. The decision at the third step is final and binding on all parties.
Professional Judgment. Contractor and its personnel shall exercise its own professional judgment in the performance of services to the persons served.
Professional Judgment. 4.1 PHARMACY reserves the right to refuse to compound or dispense any prescription in the exercise of its pharmacists' professional judgment; provided, however, that PHARMACY shall remain solely liable to any and all persons and/or entities resulting therefrom.
