Prohibited Activities and Conditions. Except for matters described in this Section 6.12, Borrower will not cause or permit Prohibited Activities or Conditions. Borrower will comply with all Hazardous Materials Laws applicable to the Mortgaged Property. Without limiting the generality of the previous sentence, Borrower will: (i) obtain and maintain all Environmental Permits required by Hazardous Materials Laws and comply with all conditions of such Environmental Permits, (ii) cooperate with any inquiry by any Governmental Authority, and (iii) comply with any governmental or judicial order that arises from any alleged Prohibited Activity or Condition.
Prohibited Activities and Conditions. Except for matters covered by a written program of operations and maintenance approved in writing by Lender (an “O&M Program”) or matters described in Section 6.2, Borrower shall not cause or permit to exist any of the following:
(a) The presence, use, generation, release, treatment, processing, storage (including storage in above ground and underground storage tanks), handling, or disposal of any Hazardous Materials in, on or under the Land or any Improvements, in violation of applicable Hazardous Materials Laws;
(b) The transportation of any Hazardous Materials to, from, or across the Land in violation of Hazardous Materials Laws;
(c) Any occurrence or condition on the Land or in the Improvements, which occurrence or condition is or may be in violation of Hazardous Materials Laws;
(d) Any violation of or noncompliance with the terms of any Environmental Permit with respect to the Land or the Improvements; or
(e) Any Lien (whether or not such Lien has priority over the Lien created by the Mortgage) upon the Land or any Improvements imposed pursuant to any Hazardous Materials Laws. The matters described in clauses (a) through (e) above are referred to collectively in this Article VI as “Prohibited Activities and Conditions” and individually as a “Prohibited Activity and Condition.”
Prohibited Activities and Conditions. Except for matters covered by a written program of operations and maintenance approved in writing by Lender (an “O&M Program”), if any, or matters described in Section 8.2 (Exclusions), Borrower shall not cause or permit any of the following:
(a) The presence, use, generation, release, treatment, processing, storage (including storage in above ground and underground storage tanks), handling, or disposal-of any Hazardous Materials in, on or under the Land, or the Improvements or any other property of Borrower that is adjacent to the Land, subject to Section 8.2 below;
(b) The transportation of any Hazardous Materials to, from, or across the Land, subject to Section 8.2 below;
(c) Any occurrence or condition on the Land or in the Improvements or any other property of Borrower that is adjacent to the Land, which occurrence or condition is or may be in violation of Hazardous Materials Laws;
(d) Any violation of or non-compliance with the terms of any Environmental Permit with respect to the Land, the Improvements or any property of Borrower that is adjacent to the Land; or
(e) Any Lien (whether or not such Lien has priority over the Lien created by the Mortgage) upon the Land or any Improvements imposed pursuant to any Hazardous Materials Laws. The matters described in clauses (a) through (d) above are referred to collectively in this ARTICLE VIII as “Prohibited Activities and Conditions” and individually as a “Prohibited Activity and Condition.”

Prohibited Activities and Conditions. Borrower will comply with all Hazardous Materials Laws applicable to any Mortgaged Property and will not cause or permit Prohibited Activities or Conditions.

(i) The presence, use, generation, release, treatment, processing, storage (including storage in above ground and underground storage tanks), handling, or disposal-of any Hazardous Materials in, on or under the Property, except in the ordinary course of Borrower’s existing business; provided, however, that the same is in accordance with all Hazardous Materials Laws and all other applicable laws;
(ii) The transportation of any Hazardous Materials to, from, or across the Property, except in the ordinary course of Borrower’s existing business; provided, however, that the same is in accordance with all Hazardous Materials Laws and all other applicable laws;
(iii) Any occurrence or condition on the Property or any other property that is adjacent to or in the vicinity of the Property, which occurrence or condition is or may be in violation of any Hazardous Materials Laws; or
(iv) Any violation of or noncompliance with the terms of any Environmental Permit with respect to the Property or any property that is adjacent to or in the vicinity of the Property. The matters described in clauses (i) through (iv) above are referred to collectively in this Section 8 as “Prohibited Activities and Conditions” and individually as a “Prohibited Activity and Condition.”
Prohibited Activities and Conditions. (i) Except for matters permitted under this Section 6.12, Borrower will not cause or permit Prohibited Activities or Conditions.
(ii) Borrower will comply with all Hazardous Materials Laws applicable to the Mortgaged Property.
(iii) Borrower will take each of the following actions:
(A) Obtain and maintain all Environmental Permits required by Hazardous Materials Laws and comply with all conditions of such Environmental Permits.
(B) Cooperate with any inquiry by any Governmental Authority.
(C) Subject to Section 6.12(g), comply with any governmental or judicial order that arises from any alleged Prohibited Activity or Condition.

Borrower shall not cause or permit, or suffer or permit Operator or Xxxxxx Xx to cause, permit or suffer, any of the following (other than in the ordinary course of business and to the extent not resulting in a material adverse effect on Borrower, Xxxxxx Xx or Operator):
(a) The presence, use, generation, release, treatment, processing, storage (including storage in above ground and underground storage tanks), handling, or disposal of any Hazardous Materials in, on, under, at or from the Property or any Improvements in violation of applicable Hazardous Materials Laws;
(b) The transportation of any Hazardous Materials to, from, or across the Property in violation of applicable Hazardous Materials Laws,
(c) Any occurrence or condition on the Property or in the Improvements or any other property of Borrower that is adjacent to the Property, which occurrence or condition is in violation of Hazardous Materials Laws; or
(d) Any material violation of or noncompliance with the terms of any Environmental Permit with respect to the Property, the Improvements or any property of Borrower that is adjacent to the Property. The matters described in clauses (a) through (d) above are referred to collectively in this Article VI as “Prohibited Activities and Conditions” and individually as a “Prohibited Activity and Condition.”
