Project Commissioning. The Project shall be declared as commissioned when the total rated commissioning capacity, along with the necessary evacuation infrastructure, has been installed and non-zero energy flows into the grid from the Project, which shall be verified by the Commissioning Committee. The date of Commissioning of the Project shall be indicated in the Commissioning Certificate issued for the Project.

Project Commissioning. APS shall engage 3rd party commissioning agents (CxA) to conduct enhanced commissioning of building systems. Prior to this, the GC shall coordinate a systematic process to ensure that the mechanical, electrical and plumbing (MEP), audio-visual, security, communications, and all other systems are fully functional in accordance with the design intent generated by the Contract Documents and APS’s operational needs, and the personnel charged with maintaining and operating them are trained (not merely familiarized) to perform operation and maintenance. The GC shall ensure all necessary approvals exist prior to equipment procurement and subsequent installation. The GC shall coordinate and chair pre-installation meetings for major MEP, structural and building envelope as well as other systems and equipment. The GC shall coordinate and participate, along with the A/E, in each Subcontractor's initial equipment testing and final systems testing, start-up demonstrations, and training for utilities, operational systems, and equipment with the A/E, Construction Manager Advisor and APS’ operations and maintenance personnel. The GC shall prepare all minutes of these items and prepare documentation of the actions, activities, and results obtained. All training shall be video-taped, and tapes shall be provided to APS as a component of the Operations and Maintenance Manuals. The CMA shall coordinate CxA as needed, attend, and participate in commissioning meetings, and monitor commissioning deficiency reports to ensure resolution of issues. The CMA shall track all commissioning activities to ensure they occur in a complete and timely fashion.
Project Commissioning. The Project should satisfy the Wind Solar Hybrid Power Project conditions and the Project will be considered as commissioned if all equipment as per rated project capacity has been installed and energy has flown into grid, the commissioning capacity shall be calculated as per the above Recital 4. The date of Commissioning of the Project shall be indicated in the Commissioning Certificate issued for the Project. Commissioning certificates shall be issued by the State Nodal Agency or CESC after successful commissioning.

(iv) Submit required documentation such as an Ontario Infrastructure and Lands Corporation Statutory Declaration, in the form and substance provided by Ontario Infrastructure and Lands Corporation clearance certificates issued by the Workplace Safety & Insurance Board pursuant to the Workplace Safety and Insurance Act, 1997, S.O. 1997, c.16 (as amended), warranties, other statutory declarations and certificates of approval or acceptance from the Authorities. (v) Ensure the conduct of "end-of-work" testing and break-in or start-up demonstration. (vi) Review inspection and testing reports to verify conformance to the intent of the documents and that changes, repairs or replacements have been completed. (vii) Meet with other consultants (e.g.: structural, mechanical, electrical) to co-ordinate completion and testing approvals. (viii) Ensure that all Mechanical and Electrical Services are turned over, at the time of completion of the Landlord's Work, in "as new condition", with warranties, dated and certified from the time specified. (ix) Arrange and co-ordinate instruction of the Landlord's staff in the care, maintenance and operation of Building systems and finishes by suppliers and sub-contractors, as required. (x) When partial occupancy of the uncompleted project is required by the Tenant, co- ordinate the Tenant's uses, requirements and access with the contractor's requirements to complete the project. (xi) Provide ongoing review, inspection and attendance to Building call-back, maintenance and repair problems during the warranty periods. Project Commissioning. 5.1. The commissioning of the Project (the "Project Commissioning") shall be deemed to be achieved when: a) When the Concessionaire has established the Mechanized Laundry Facilities and all machinery, equipment, furniture and fixtures have been installed at the Project Facilities. b) Required staffs have been recruited and are available at the Project Facility(s). 5.2. The Concessionaire shall have to achieve Project Commissioning for the Project within 6 (six) months from meeting of the Conditions Precedent by both the Parties. 5.3. The Concessionaire shall prior to 15 days from the likely date of Project Commissioning, notify the Project Management Committee about the completion of Project Commissioning. Within 7 days of the date of the notification, the Project Management Committee shall inspect and verify the completion of activities mentioned under Clause 5. 1. The Project Management Committee shall either certify the Project Commissioning or communicate the deficiencies/observations, if any, within 7 days of completion of inspection. In case certain deficiencies are observed by the Project Management Committee , the same shall be rectified by the Concessionaire within 7 days or such date mentioned in the communication by the Project Management Committee . Upon rectification, the process specified under this Clause 5.1 shall be repeated. In case no communication received from the Project Management Committee till 15th day of the date of notification by the Concessionaire, the Project Commissioning is deemed to be approved by the Project Management Committee. For the avoidance of doubt, the Project Commissioning is considered to be completed upon certification by the Project Management Committee. 5.4. In case the Concessionaire does not commence operations within 6 (six) months from the date of meeting the Condition Precedent by both the Parties, then the Authority in its discretion may extend the timeline upon receiving written request of the Concessionaire. In the event, the Concessionaire fails with the Project Commissioning within the extended timeline, the Authority shall be entitled to terminate the Agreement and forfeit the Performance Security furnished by the Concessionaire, provided however, that if the Concessionaire is unable to commence operation for reasons solely attributable to Force Majeure the same shall not be considered as its event of default. 5.5. Project Commissioning. 1.9.1. The Consultant shall assist the Authority during design, construction, and post-construction phases to ensure that the Authority’s new and existing facilities are well-designed, complete, properly functioning, and economical to operate and maintain, and that the Authority’s staff has adequate training and documentation to safely and efficiently operate and maintain its facilities. Services shall include, but not be limited to, design review, commissioning specification development, development and observation of testing plans, systems documentation, warranty inspections, training, retro-commissioning, and “LEED 2009” (or current version) requirements. LEED and sustainable design criteria shall be evaluated by the Consultant as part of the commissioning process (as further described in the Capital Programs Manual II: Guidelines for Consultants).
