Common use of PROJECT CREDITS Clause in Contracts

PROJECT CREDITS. ‌ 12.1 The Owner will be entitled to any and all Project Credits related to the Work, the Facility and its operation. 12.2 The Design-Builder will, on behalf of the Owner, apply to BC Hydro (subject to Section 11), CaGBC, and any other applicable incentive programs (“Credit Provider”) and take all reasonable steps to obtain for the Owner the maximum benefits (funding, rebates, incentives and cost savings) offered by each Credit Provider under such program(s).‌‌ 12.3 Without limitation, the Design-Builder will: (a) meet with Credit Providers at an early stage of the design of the Project; (b) carry out any required studies and modelling;‌ (c) collaborate with each Credit Provider to identify potential improvements to the Facility design and methods of performing the Work that may achieve greater Project Credits; and (d) use all commercially reasonable efforts to maximize available Project Credits through the Design and Construction of the Facility (to the extent possible while maintaining consistency with the Statement of Requirements).
