Proportionate Shares. The Term Loan shall be made, and all participations purchased, by the Lenders simultaneously and proportionately to their respective Proportionate Shares, it being understood that no Lender shall be responsible for any default by any other Lender in such other Lender’s obligation to make a Term Loan hereunder or purchase a participation required hereby nor shall the Commitment of any Lender be increased or decreased as a result of a default by any other Lender in such Lender’s obligation to make a Term Loan requested hereunder or purchase a participation required hereby.
Proportionate Shares. A. Section 1.12 of the Lease is amended to read in its entirety:
Proportionate Shares. All Loans shall be made by the Lenders proportionately to their respective Proportionate Shares, it being understood that no Lender shall be responsible for any default by any other Lender in such other Lender’s obligation to make a Loan requested hereunder nor shall any Commitment of any Lender be increased or decreased as a result of a default by any other Lender in such other Lender’s obligation to make a Loan requested hereunder or purchase a participation required hereby.
Proportionate Shares. An exhibit to such New Lease comparable to Schedule 2 attached to this Lease shall include a Tenant’s Proportionate Share for each Facility located on the Transferred Premises covered by the New Lease equal to the percentage that the Fixed Rent allocable to such Facility under the New Lease comprises of the aggregate Fixed Rent for all Facilities located on all of the Transferred Premises under such New Lease (and the aggregate of all such Tenant’s Proportionate Shares under such New Lease shall equal one hundred percent (100%)).
Proportionate Shares. Except to the extent otherwise provided herein and subject to Section 1.13: (i) each borrowing of the Revolving Credit Loan from Lenders shall be incurred and made by the Lenders according to their respective Proportionate Shares; and (ii) each payment or prepayment of principal of the Revolving Credit Loan by Borrower shall be made for the account of the relevant Lenders in accordance with their respective Proportionate Shares; and
Proportionate Shares. Except to the extent otherwise provided herein and subject to Section 1.13: (i) each borrowing of the Revolving Credit Loan from Lenders shall be incurred and made by the Lenders according to their respective Proportionate Shares; and
Proportionate Shares. Proportionate Shares. Lessee’s Proportionate Share is amended to be 42.16% effective October 1, 2008 and amended to be 47.03% effective February 1, 2009.
Proportionate Shares. The results of underwriting operations will be apportioned cumulatively, without restatement of prior periods. The proportionate shares of the Companies are as follows: Zenith Insurance Company 97.5 % ZNAT Insurance Company 2.0 % Zenith Star Insurance Company 0.5 % The proportionate shares of Zenith, ZNAT and Zenith Star may be changed from time to time by mutual consent as of the close of any calendar year quarter. Such changes shall be set forth in an endorsement to this Agreement.
Proportionate Shares. To the extent that any sum falling payable to more than one person in accordance with Clause 15.15 is greater than the amount available to be applied in order to pay such sum, and such persons have an equal ranking claim to such sum, each Security Representative shall distribute the amounts so available between the persons so entitled so as to ensure that the sums owing to such persons are reduced by an equal proportion.
