Proposed Effective Date. The NYISO respectfully requests that the Commission allow the RC Agreement to become effective as of October 25, 2019, the date that the RC Agreement was executed by the Parties. The RC Agreement is designed to strengthen the reliability of the NYCA and the broader Bulk Power System, and an earlier effective date will help to promote reliability. Accordingly, the NYISO submits that good cause exists for a waiver of the Commission’s prior notice requirements necessary to allow the RC Agreement to become effective as of October 25, 2019.
Proposed Effective Date. Ginna respectfully requests that the proposed RSSA revisions be made effective on October 2, 2015, the date when Ginna’s right to terminate pursuant to Section 2.1(c), as amended by the Fourth Extension Filing, would otherwise expire. Good cause exists for the Commission to waive its prior notice requirement.11 First, RG&E supports the requested waiver, and the Commission routinely grants waiver of prior notice where all parties to an agreement support waiver, as is the case here.12 Second, the Amendment has no impact on the rates contained in the RSSA.13 Rather, it pertains to the respective rights between Ginna and RG&E. Third, by executing the Amendment Xx. 0 xx xxx XXXX, XX&X and Ginna made a contractual agreement accepting the revisions contained in the amendment and the proposed October 2, 2015 effective date.14 Furthermore, good cause exists to grant the waiver because it will permit Ginna, RG&E and the other parties in the RSSA Proceeding to continue good faith settlement negotiations.
