Public Infrastructure. All public infrastructure improvements shall be constructed according to the River Heights City design standards and specifications.
Public Infrastructure. As part of the Project and as required by this Community Benefits Agreement, Owner will provide the following public infrastructure: Bike and Pedestrian Facilities and Paths: 12 ft wide multi-use path around the property and also connecting to neighboring parcels. A total of 7,818 linear feet of paths will be constructed. Bike storage and repair facilities will be included. Parks and Greenspace: There will be a 19.57-acre reduction of impervious surfaces. Intersection Improvements: 3 traffic circles, pedestrian crosswalks, urban street grid/intersections. Stormwater Remediation and Facilities: Storm facilities to bring the current site to code and which will help alleviate some downstream flooding and water quality issues. Detention facilities are designed to be aesthetically pleasing and incorporated into the common areas. Common Areas and Public Spaces: Central gathering courtyard and enhanced pedestrian experiences at retail storefronts. Paving and curb/gutter for the new street grid and road layout. Landscape/Sitework/Utility: Installation of 1,024 trees that are 2" caliper or greater. Reforestation of 24,500 sf of green space. Utility services and network brought up to current requirements. Publicly Dedicated Property: Owner will convey to the public, pursuant to this Agreement and without cost, by means of licenses and/or public easements in favor of ACC, an interest in all of the Project’s horizontal improvements, such as roads, stormwater system, traffic circles, park/greenspace and a multi-use trail (such interest, the “Publicly Dedicated Property), and will assume and pay all costs of operating and maintaining such horizontal improvements. Such licenses and/or public easements shall be in form and substance reasonably satisfactory to ACC and shall require Owner to pay its customary share of common area maintenance (CAM) and comply with all applicable laws and regulations and association rules, regulations, maintenance and other requirements. The public infrastructure referred to in clauses (1)-(8), above is part of the Horizontal Infrastructure for the respective Phases, and the construction thereof shall respectively start and shall be completed, subject to Force Majeure, according to the Project Construction Schedule for the respective Phases. Public Infrastructure. A building, highway, road, excavation, and repair work or other project development or public improvement on the Project Site, paid for in whole or in part from public funds, without regard to whether the work is done under public supervision or direction, and the categories of work included in the definition of Project in this Agreement.
Public Infrastructure. The word "Public Infrastructure" means all water, wastewater/sewer, detention and drainage, roadway, park and trail, and other infrastructure necessary to serve the full development of the Property and/or to be constructed and dedicated to the City under this Agreement.

Seller shall assign to Buyer all of Seller’s rights pursuant to Paragraph 8 and Exhibit L of the Vesting PSA (the “Infrastructure Rights”) by executing and delivering the Assignment of Infrastructure Rights.
Public Infrastructure. Permanent attachments to public infrastructure including, but not limited to, streets, sidewalks, curbs, trash cans, light poles, traffic signs, trees, bike racks, fire hydrants, etc. are NOT permitted. Damage to public infrastructure as a result of the outdoor seating or other business use may result in revocation of the encroachment permit.
Public Infrastructure. The Developer, at its sole cost, shall design, construct and maintain, until acceptance by the City and/or County, as applicable, and conveyance by recordable instrument or xxxx of sale, as appropriate, to the City, all public infrastructure facilities and lands necessary to serve the Project which are shown on the Concept Plan, provided that said public infrastructure facilities have received construction plan approval and that all applicable review procedures have been complied with fully, inspected and accepted by the City and/or County, as applicable. Public infrastructure facilities shall include those facilities to be located in rights-of-way or easement areas conveyed to the City and/or County, as applicable, and are shown on the approved engineering construction drawings.
10.1 Public infrastructure facilities necessary to service and that benefit a Phase of Development shall be complete and approved for acceptance by the City, County and/or the governmental agency having authority, as applicable, prior to the issuance of a certificate of occupancy for the respective Phase of Development. Alternatively, the Developer shall provide the appropriate letter of credit in a form satisfactory to the City Attorney, drawable on or through a local Pinellas County bank. Said letter of credit shall be deposited with the City to guarantee the completion of public infrastructure facilities prior to the time that certificates of occupancy are issued for the respective Phase of Development and public access and facilities to serve the proposed structures are available in accordance with City regulations.
Public Infrastructure. United States annual grant assistance under subsection (a) of this section shall be made available in accordance with the plan described in subsection (c) of this section and for projects included in the plan described in Article VII(2) of the 2023 Fiscal Procedures Agreement to assist the Government of the Republic of the Xxxxxxxx Islands in its efforts to provide adequate public infrastructure.
Public Infrastructure. (1) Unless otherwise agreed, not less than 30 percent and not more than 50 percent of U.S. annual grant assistance provided under this section shall be made available in accordance with a list of specific projects included in the infrastructure improvement and maintenance plan prepared by the Government of the Republic of the Xxxxxxxx Islands as part of the strategic framework described in subsection (f) of this section.
Public Infrastructure. (i) U.S. annual grant assistance shall be made available in accordance with a list of specific projects included in the plan described in subsection (c) of this section to assist the Government of the Federated States of Micronesia in its efforts to provide adequate public infrastructure.
(ii) Infrastructure and Maintenance Fund. Five percent of the annual public infrastructure grant made available under paragraph (i) of this subsection shall be set aside, with an equal contribution from the Government of the Federated States of Micronesia, as a contribution to an Infrastructure Maintenance Fund (IMF). Administration of the Infrastructure Maintenance Fund shall be xxxx rned by the Fiscal Procedures Agreement.
