Common use of Publicity; Confidentiality Clause in Contracts

Publicity; Confidentiality. (a) All press releases or other public communications of any nature relating to this Agreement, the other Transactions Documents and the transactions contemplated hereby or thereby, and the method of the release for publication thereof, shall be subject to the prior mutual approval of the Primary Purchaser and the Company which approval shall not be unreasonably withheld by such parties; provided however, that nothing herein shall prevent any party from publishing such press release or other public communications as may be required by applicable law or stock exchange rule after consultation with the other parties hereto as is reasonable under the circumstances. (b) The Primary Purchaser and the Company agree that they shall remain bound by the terms of the Non Disclosure Agreement dated May 2, 2001, between the Primary Purchaser and the Company.
