Quiet Use and Enjoyment. If and as long as Tenant shall faithfully perform the agreements, terms, covenants and conditions hereof, Tenant shall and may (subject, however, to the provisions, reservations, terms and conditions of this Lease, including without limitation, Sections 17.01 and 17.02) peaceably and quietly have, hold and enjoy the Premises for the Term hereby granted, including extensions, without molestation or disturbance by or from Landlord or any Person or entity claiming by, through or under Landlord and free of any encumbrance created or suffered by Landlord, except from encumbrances created, suffered or consented to by Tenant. This covenant shall be construed as running with the land to and against subsequent owners and successors in interest and is not, nor shall it operate or be construed as, a personal covenant of Landlord, except to the extent of Landlord’s interest in the Premises and only so long as such interest shall continue, and thereafter this covenant shall be binding upon such subsequent owners and successors in interest of Landlord’s interest under this Lease, to the extent of their respective interests, as and when they shall acquire the same, and only so long as they shall retain such interest.

Quiet Use and Enjoyment. Landlord covenants, in lieu of any implied covenant of quiet possession or quiet enjoyment, that so long as Tenant is in compliance with the covenants and conditions set forth in this Lease, Tenant shall have the right to quiet use and enjoyment of the Premises without hindrance or interference from Landlord or those claiming through Landlord, subject to the covenants and conditions set forth in this Lease.

Quiet Use and Enjoyment. Owner agrees that NO loud or unruly use of the Clubhouse shall be permitted. No more than 110 persons shall be in the Clubhouse at one time. The Owner agrees to private use only and NO admission fees will be charged or merchandise or liquor sold. NO smoking is permitted in the Clubhouse or pool area. The Loudoun County Police Department is giving the express right to enter the Clubhouse during any private party. If the police determine that occupancy is in excess of maximum capacity, or that the party causing a disturbance of the peace, or that any other violation of the law is occurring, Owners aggress that the party will be immediately terminated and all persons will vacate the Clubhouse. In such event, Owner’s Deposit under Section 1 shall be forfeited. If the police are called upon to respond to complaints by residents of excessive noise or other disturbances, the Deposit will be forfeited.
