RAISING OF FINANCE BY PROMOTER. The Promoter shall have the right to raise finance and/or loan from any financial institution and/or bank and for that purpose create mortgage, charge on the Land and/or securitization of the receivables however the Promoter shall not mortgage or create a charge on the Apartment after execution of this Agreement and if any such mortgage or charge is made or created then notwithstanding anything contained in any other law for the time being in force, such mortgage or charge shall not affect the right and interest of the Allottee who has taken or agreed to take such Apartment.
RAISING OF FINANCE BY PROMOTER. The Allottee understands and acknowledges that the said Land has been mortgaged by the Promoter to LIC of India for securing the Loan availed by the Promoter for the purpose of construction of the Project on the said Land and the Allottees takes notice that he/she/they is/are required to obtain a No Objection Certificate from LIC of India for creation of any encumbrances on the said Land. The Allotees agrees and undertakes that he/she/they shall not create any encumbrances over the said Apartment till such time an NOC in writing is received from LIC of India.
RAISING OF FINANCE BY PROMOTER. For the purpose of facilitating the construction of the said new building the Promoter has obtained financial assistance from Axis Bank Ltd and shall also have the option to obtain financial assistance from any other banks and other financial institutions. In this regard the Allottee understands and acknowledges that the said entire property has been mortgaged by Sky View Developer to Axis Bank Limited for securing the Loan availed by the said Sky View Developer for the purpose of construction of the said Entire property and the Allottee takes notice that he/she/they is/are required to obtain a No Objection Certificate from Axis Bank Limited for creation of any encumbrances on the said Entire property. The Allottee agrees and undertakes that he/she they shall not create any encumbrances over the said Entire property/outlets till such time an NOC in writing is received from Axis Bank Limited.
