A Shipper seeking to direct gas into storage shall nominate “Storage” as the Point of Delivery on Bay Gas’ system and shall identify the number of the Storage Service Agreement to be used for the receipt of such gas into storage. A Shipper seeking to withdraw gas from storage shall nominate “Storage” as the Point of Redelivery from Bay Gas’ system and shall identify the number of the Storage Service Agreement under which the gas is to be withdrawn from storage. Receipt and Delivery. Producers agree to tender, or cause to be tendered, to the ▇▇▇▇▇▇▇ Receipt Points, Producers’ Gas and MV Mitigation Gas, each Day, and Gatherer agrees to accept Producers’ Gas and MV Mitigation Gas at the ▇▇▇▇▇▇▇ Receipt Points and redeliver Producers’ Gas and MV Mitigation Gas to the ▇▇▇▇▇▇▇ Delivery Points, subject to and on the terms provided in this Agreement. Nominations of Producers’ Gas and MV Mitigation Gas shall be made in accordance with the procedures in Exhibit B.
Receipt and Delivery. Producer agrees to tender, or cause to be tendered, to the Receipt Points, Producer’s Gas, each Day, and Gatherer agrees to accept Producer’s Gas at the Receipt Points and redeliver Producer’s Gas, to the Delivery Points, subject to the terms hereof. Producer shall endeavor to deliver the daily quantities of Gas at each Receipt Point at a reasonably constant rate.

To receive and deliver goods and merchandise only through the loading dock designated from time to time by Landlord, during ordinary weekday business hours (except for Saturday deliveries by overnight courier firms such as Federal Express), and to cause all messenger and small scale deliveries to be made through the Building security desk, all in accordance with Landlord’s rules and regulations therefor. Without limitation, no “hand trucks” shall be used in the lobby areas of the Building.

Operator shall operate the Facility in a manner that allows shipments of Crude Oil into and out of the Facility twenty-four (24) hours per day, seven (7) days per week, subject to the requirements of the next paragraph. Customer and its employees, contractors, agents and representatives (collectively, “Customer's Representatives”) shall be subject to and abide by the rules of the Facility, as such rules may change from time to time, and shall instruct Customer's Representatives to abide by such rules. Customer will be solely responsible for any pump over fees charged by third party carriers for movements of Customer's Crude Oil to and from the Facility.

Gatherer agrees to accept Producers’ Gas at the PRP Receipt Points and redeliver Producers’ Gas to the PRP Delivery Points, to the extent capacity is available, subject to and on the terms provided in this Agreement. Prior to June 30, 2019, if Gatherer does not have sufficient capacity to accept Producers Gas, Gatherer shall use all commercially reasonable and diligent efforts to construct the necessary facilities. If after the use of such efforts the necessary facilities have not been constructed or Gatherer determines in good faith that it will not be able to construct such facilities using commercially reasonable and diligent efforts, the Producers may request and Gatherer shall provide a written release of the portion of the Producers’ Remaining Properties and ▇▇▇▇▇ located thereon that would have been served by such Facilities. Nominations of Producers’ Gas shall be made in accordance with the procedures in Exhibit D.
Receipt and Delivery. 1.1 Gatherer shall receive the water produced by Producer from the Properties at or near the ▇▇▇▇▇ identified on Exhibit “A” attached hereto. Exhibit “A” may be amended from time to time by mutual agreement of Producer and Gatherer.
1.2 As between Producer and Gatherer, Gatherer shall be responsible for the proper treatment and disposal of produced water. Gatherer shall have the exclusive control and possession of produced water after delivery to the System and shall be responsible for any and all injury, damage or loss caused thereby.
1.3 Gatherer agrees to accept and to receive at the point of receipt such quantities of produced water as Gatherer is allowed to dispose of under all applicable laws.
Receipt and Delivery. Producers agree to tender, or cause to be tendered, to the Midcon Receipt Points, Producers’ Gas or MV Mitigation Gas, each Day, and Gatherer agrees to accept Producers’ Gas and MV Mitigation Gas at the Midcon Receipt Points and redeliver Producers’ Gas and MV Mitigation Gas to the Midcon Delivery Points, subject to and on the terms provided in this Agreement. Prior to June 30, 2019, if Gatherer does not have sufficient capacity to accept Producers’ Gas and MV Mitigation Gas, Gatherer shall exercise commercially reasonable efforts to construct facilities to accept such excess volumes of Producers’ Gas and MV Mitigation Gas, such construction to be completed as promptly as is commercially reasonable. If after exercising such efforts the facilities have not been constructed or Gatherer determines in good faith that it will not be able to construct such facilities exercising commercially reasonable efforts, Producers may request, and Gatherer shall promptly provide, a written release of the spacing/drilling unit for the ▇▇▇▇▇ that would have been served by such facilities. Nominations of Producers’ Gas and MV Mitigation Gas shall be made in accordance with the procedures in Exhibit D.
Receipt and Delivery. In connection with such sale, Seller shall from time-to-time and adhering to the Nomination Procedures receive Products for storage from Buyer at the Receipt Point(s) for injection into the Storage Wel▇▇; ▇rovided, that Seller shall not be obligated to receive from Buyer any quantity of Products for injection which (a) would cause Buyer's Product Storage Account to exceed the Available Storage Capacity for each Storage Well or (b) is at a rate greater than the rate contemplated by the Maximum Daily Injection Quantity. Seller shall from time-to-time and adhering to the Nomination Procedures deliver Products to Buyer at the Delivery Point(s); provided, that Seller shall not be obligated to deliver to Buyer any quantity of Product that is at a rate greater than the rate contemplated by the Maximum Daily Withdrawal Quantity. In connection with the foregoing, Seller agrees (y) to return to Buyer in accordance with the terms and conditions of this Agreement all Products delivered into storage hereunder and (z) in connection with the removal of all Product from any Storage Well, to deliver to Buyer all product in such Storage Well, notwithstanding that volumes recorded in the Product Storage Account may be less than the volume of product in such Storage Well (or to deliver Buyer's ratable share of such product in such Storage Well if a third party has contracted with Seller and stored product in such Storage Well).
