Recording; Modification. A memorandum of the Ground Lease has been duly recorded. The Ground Lease permits the interest of Borrower to be encumbered by the Security Instrument and does not restrict the use of the Property in a manner that would adversely affect the security provided by the Security Instrument. As of the date hereof, there are no other amendments, modifications, assumptions or assignments of the Ground Lease not heretofore delivered to Lender. The Ground Lease may not be canceled, terminated, surrendered, modified or amended without the prior written consent of Lender and any such action without such consent shall not be binding on Lender.

Except as described in the definition of “Ground Lease”, there have not been amendments or modifications to the terms of the Ground Lease since its recordation. Assuming compliance by Lender with Section 15.2 of the Ground Lease, the Ground Lease may not be canceled, surrendered or modified without the prior written consent of Lender.
Recording; Modification. True, correct and complete copies of each Ground Lease including all amendments and modifications thereto, have been provided to Lender. The Ground Leases or a memorandum regarding each Ground Lease (or any combination thereof) have been duly recorded. The Ground Leases permit the interest of the applicable Individual Borrower to be encumbered by a mortgage without the consent of the Ground Lessor or the binding written approval and consent of the applicable Ground Lessor(s) thereunder has been obtained. The Ground Leases may not be canceled, surrendered or amended without the prior written consent of Lender.

There have not been amendments or modifications to the terms of the Ground Lease since its recordation, with the exception of written instruments which have been recorded.

The Ground Lease permits the interest of Mortgage Borrower to be encumbered by a mortgage (provided that the mortgage is at all times subject and subordinate to the Ground Lease) or the ground lessor has approved and consented to the encumbrance of the Individual Property by the related Mortgage. The Ground Lease may not be terminated, surrendered or amended without the prior written consent of Mortgage Lender; provided that the ground lessor shall not be prevented from exercising its remedies in accordance with the Ground Lease if the obligations of Mortgage Borrower under the Ground Lease are not performed as provided in the Ground Lease.

The Ground Lease permits the interest of El Con Mortgage Borrower to be encumbered by a mortgage or the Ground Lessor has approved and consented to the encumbrance of the applicable Individual Property by the related Mortgage. There have not been amendments or modifications to the terms of the Ground Lease since recordation of the Ground Lease, with the exception of written amendments or modifications, copies of which have been delivered to Lender. The Ground Lease may not be terminated, surrendered or amended without the prior written consent of Lender; provided that Ground Lessor shall not be prevented from exercising its remedies in accordance with the Ground Lease if the obligations of El Con Mortgage Borrower under the Ground Lease are not performed as provided in the Ground Lease.
Recording; Modification. Each Ground Lease (or a memorandum thereof) has been duly recorded. Each Ground Lease permits the interest of Mortgage Borrower to be encumbered by a mortgage and/or the applicable ground lessor has approved and consented to the encumbrance of the applicable Individual Property by the Mortgage thereon. There have not been any amendments or modifications to the terms of the related Ground Lease since recordation of such Ground Lease (or a memorandum thereof), with the exception of written instruments which have been recorded or estoppels delivered in connection with the Loan. No Ground Lease may be terminated, surrendered or materially amended without the prior written consent of Mortgage Lender; provided that no ground lessor shall be prevented from exercising its remedies in accordance with the applicable Ground Lease if the obligations of the applicable Borrower under the applicable Ground Lease are not performed as provided in such Ground Lease.
Recording; Modification. Such Ground Lease (or a memorandum thereof) was recorded in the applicable recording office and with the related recording information respectively set forth on Schedule IV hereto. Such Ground Lease permits the interest of Borrower to be encumbered by a mortgage (provided that such mortgage is at all times subject and subordinate to the Ground Lease) or the Ground Lessor thereunder has approved and consented to the encumbrance of the applicable Ground Lease Property by the related Mortgage. There have not been amendments or modifications to the terms of such Ground Lease since recordation of the same (or a memoranda thereof). Such Ground Lease provides that it may not be terminated, surrendered or amended without the prior written consent of Lender as a mortgagee of the interest of Borrower other than any provisions thereof that provides that the Ground Lessor thereunder may exercise its remedies in accordance with such Ground Lease if the obligations of Borrower under the Ground Lease are not performed or cured by such mortgagee as provided in the Ground Lease.
Recording; Modification. A memorandum of each Ground Lease has been duly recorded. After giving effect to the ground lease estoppel delivered by the applicable Ground Lessor in connection with the closing of the Loan, each Ground Lease permits the interests of Borrowers to be encumbered by the Mortgage. True and correct copies of the Ground Leases have been provided to Administrative Agent and except as previously provided to Administrative Agent, there have not been amendments or modifications to the terms of any Ground Lease. After giving effect to the ground lease estoppel delivered by the applicable Ground Lessor in connection with the closing of the Loan, no Ground Lease may be canceled, terminated, surrendered or amended without the prior written consent of Administrative Agent.
Recording; Modification. Except as set forth on Schedule 7.31, (i) each Ground Lease or a memorandum thereof has been duly recorded, (ii) the Ground Leases permit the interest of the applicable Property Guarantor to be encumbered by a mortgage and (iii) there have not been amendments or modifications to the terms of any Ground Lease since its recordation, with the exception of written instruments which have been recorded. No Property Guarantor shall cancel, terminate, surrender or materially amend, or permit the cancellation, termination, surrender or material amendment of, any Ground Lease without the prior written consent of Administrative Agent.
