Recordings and Records. Either you or we may produce telephonic or electronic recordings or computer records, including electronic mail and facsimile transmissions, as evidence in any proceedings brought in connection with any service. You agree to our telephonic or electronic recording for security and quality of service purposes. You assume the duty of obtaining the required consents from your employees and/or agents for these recordings. If our records about a request are different than your records, our records will control. Our records include written records and any audio recordings about wire transfers.

Any documents or Items (as defined in Chapter 2, Article 3 below) may be destroyed at the discretion of the Bank after being microfilmed or recorded and preserved and/or processed in any other manner.

Recordings and Records. Customer shall retain each check which has been converted to a digital image in a safe and secure environment for such time as Customer deems necessary and advisable, but in no event fewer than seventy five (75) days after such check has been digitized and processed. Customer will promptly (but in any event within five (5) Banking Days) provide any retained check (or, if the check is no longer in existence, a sufficient copy of the front and back of the check) to Bank as requested to aid in the clearing and collection process or to resolve claims by third parties with respect to any check or imaged item. Customer will use a commercially reasonable method approved by Bank to destroy checks after Customer's retention period has expired.
