RELATIONSHIP TO PREVIOUS AGREEMENTS. It is the parties’ intention that this Agreement comprehensively sets out the terms and conditions of employees whose classifications fall within the coverage of this Agreement. Accordingly, this Agreement wholly replaces any other industrial agreement (including any Certified Agreement or Award) which would otherwise have effect in respect of those employees’ employment.
RELATIONSHIP TO PREVIOUS AGREEMENTS. Unless otherwise expressly stated in this Agreement, this Agreement supersedes and revokes any agreements previously applying to the parties.
RELATIONSHIP TO PREVIOUS AGREEMENTS. This Agreement rescinds and replaces all previous Xxxxx Incorporated Enterprise Agreements. The terms of any applicable awards will not apply whilst this Agreement operates.
RELATIONSHIP TO PREVIOUS AGREEMENTS. This Agreement operates so as to incorporate all of the provisions of any previous certified or uncertified Agreement operating prior to the certification of this Agreement and nothing in this Agreement shall diminish the terms and conditions of employment applicable in previous Agreement(s). It is a term of this agreement that there will be no trade-offs or reductions in terms or conditions of employment as a result of the making of this agreement. The parties agree that over the life of the agreement they will meet and confer on a process of consolidation of all existing agreements and conditions (excluding award conditions). The parties will incorporate the agreed consolidated document into the next agreement. For the avoidance of doubt the appendices attached to this agreement are part of this agreement.
RELATIONSHIP TO PREVIOUS AGREEMENTS. 5.1 This Agreement is read to the exclusion of any relevant award.
5.2 This Agreement replaces the Mayne Health/HSUA Hospitals Certified Agreement 2002- 2005 and all previous agreements applying to the Hospital (‘the replaced agreement/s), save that no liability accrued or incurred under the replaced agreement/s or the awards with which they were read in conjunction referred to at 5.3 below shall be affected as a result of this Agreement .
5.3 For the purposes of determining any liability accrued or incurred under the replaced agreement/s prior to this Agreement, they were read in conjunction with the following awards, which are now Notional Agreements Preserving State Awards: • Private Hospital Employees (State) Award – NSW • The Private Hospitals and Aged and Disability Care Services Industry Redundancy (State) Award - NSW; • Private Health and Charitable Sector Employees Superannuation (State) Award - NSW;
RELATIONSHIP TO PREVIOUS AGREEMENTS. 1.1 The terms and conditions of this Agreement shall supersede and replace the terms and conditions of the Development Agreement, as amended by Amendments No. 1 and No. 2 dated respectively July 1994 and February 1995 (hereinafter the "1993 Agreement"), the agreement between CATALYTICA and MFIC dated January 1, 1995 (hereinafter the "1995 Agreement") all of which will become null and void as of the effective date of this Agreement. Notwithstanding the foregoing, the Confidentiality and Non-Disclosure Agreement between the Parties dated April 6, 1995 (the "Confidentiality Agreement") will survive in full force and effect unaltered by this Agreement except that it will also be binding upon CATI. All Confidential Information communicated hereunder to either Party, its officers, employees, consultants and agents, either through the time of execution of this Agreement or disclosed hereafter, will be governed and protected by the provisions of such Confidentiality Agreement. Notwithstanding the substitution of CATI in place of CATALYTICA, CATALYTICA shall be jointly and severally liable for any and all obligations, damages or other claims or causes of actions that MFIC now has or will have in the future against CATI, and CATI specifically warrants and represents that it has the proper authority and capacity to so bind CATALYTICA.
RELATIONSHIP TO PREVIOUS AGREEMENTS. This agreement supersedes in full the RACV Metropolitan Patrols Certified Agreement 2006-09. All previous agreements are extinguished. This agreement supersedes all previous verbal and informal understandings and agreements. Relevant previous agreements have been included in this document. Formal written policies and procedures from RACV management will continue to prevail except where inconsistent with the provisions of this agreement, in which case the terms of this agreement will prevail.
RELATIONSHIP TO PREVIOUS AGREEMENTS. (a) It is agreed between the parties that the terms and conditions prescribed by the Green’s General Foods Enterprise Agreement 2003, the Greens General Foods Enterprise Agreement 2002 which includes the terms and conditions prescribed by the Green’s General Foods Enterprise Agreement 1998 and the amendments agreed to between the parties in the Company’s letter to the NUW dated 1 March 2001 will continue to be observed throughout the life of the Agreement.
(b) Where there is any inconsistency between any of the terms of this Agreement and the terms and conditions prescribed by the Green’s General Foods Enterprise Agreement 2003, or the Green’s General Foods Enterprise Agreement 2002 the terms of this Agreement will prevail.
RELATIONSHIP TO PREVIOUS AGREEMENTS. This Agreement replaces all and any previous agreements made between the Broken Hill Town Employees’ Union and the Club, including specifically the Barrier Social Democratic Club Enterprise Agreement 2002 (the 2002 Agreement) which itself replaced the previous existing Agreement which was known as the Industrial Agreement between the Barrier Social Democratic Club, the Town Employees’ Union and the Barrier Industrial Council 1993 - 1995 (the 1993 Agreement).
RELATIONSHIP TO PREVIOUS AGREEMENTS. Subject to clause 6 above, it is the parties’ intention that this Agreement comprehensively sets out the terms and conditions of the Employees. Accordingly, this Agreement wholly replaces any other industrial agreement (including any Certified Agreement or Award) which would otherwise have effect in respect of those Employees’ employment.
