Relationship With Landlord. Tenant hereby assigns and transfers to Landlord Tenant’s interest in the Sublease and all rentals and income arising therefrom, subject to the terms of this Section 3. Landlord, by consenting to the Sublease agrees that until a default shall occur in the performance of Tenant’s obligations under the Lease, Tenant may receive, collect and enjoy the rents accruing under the Sublease. In the event Tenant shall default in the performance of its obligations to Landlord under the Lease, then whether or not Landlord terminates the Lease, Landlord may, at its option by notice to Tenant, either (i) terminate the Sublease, (ii) elect to receive and collect, directly from Subtenant, all rent and any other sums owing and to be owed under the Sublease, as further set forth in Section 3.l below, or (iii) elect to succeed to Tenant’s interest in the Sublease and cause Subtenant to attorn to Landlord, as further set forth in Section 3.2 below.

Relationship With Landlord. Tenant hereby assigns and transfers to Landlord (strictly as security for Tenant’s 's obligations under the Lease, and which shall not be construed as amending Section 14.3 of the Lease) the Tenant's interest in the Sublease and all rentals and income arising therefrom, subject to the terms of this Section 3. Landlord, by consenting to the Sublease agrees that until a default shall occur in the performance of Tenant’s 's obligations under the Lease, Tenant may receive, collect and enjoy the rents accruing under the Sublease, subject to Landlord's right to receive the Transfer Premium pursuant to Section 14.3 of the Lease. In the event Tenant shall default in the performance of its obligations to Landlord under Section 19.1 of the Lease, then whether or not Lease (and Landlord terminates the Lease), Landlord may, in connection with Section 19.4 of the Lease, at its option by notice to Tenant, either (i) terminate the Sublease, (ii) elect to receive and collect, directly from Subtenant, all rent and any other sums owing and to be owed under the Sublease, as further set forth in Section 3.l 3.1, below, or (iii) elect to succeed to Tenant’s 's interest in the Sublease and cause Subtenant to attorn to Landlord, as further set forth in Section 3.2 3.2, below.

Landlord, by consenting to the Sublease agrees that until a default shall occur in the performance of Tenant’s 's obligations under the Lease, Tenant may receive, collect and enjoy the rents accruing under the Sublease. In the event Tenant shall default in the performance of its obligations to Landlord under Paragraph 18 of the Lease, then Lease (whether or not Landlord terminates the Lease), Landlord may, at its option by notice to Tenant, either (i) terminate the Sublease, (ii) elect to receive and collect, directly from Subtenant, all rent and any other sums owing and to be owed under the Sublease, as further set forth in Section 3.l 3.1, below, or (iii) elect to succeed to Tenant’s 's interest in the Sublease and cause Subtenant to attorn to Landlord, as further set forth in Section 3.2 3.2, below.

In the event Tenant shall default in the performance of its obligations to Landlord under the Lease, then Lease (whether or not Landlord terminates the Lease), however, Landlord may, at its option option, by giving notice to Tenant, either (i) terminate the Sublease, (ii) elect to receive and collect, directly from Subtenant, all rent and any other sums owing and to be owed under the Sublease, as further set forth in Section 3.l 3.1, below, or and/or (iii) elect to succeed to Tenant’s interest in the Sublease Sublease, and cause Subtenant to attorn to Landlord, as further set forth in Section 3.2 3.2, below. If Landlord elects to terminate the Sublease pursuant to section 3(i) above, Subtenant acknowledges and agrees that Landlord shall have no liability to Subtenant as a result thereof.

Relationship With Landlord. Tenant hereby assigns and transfers to Landlord Landlord, pursuant to the express terms and conditions of this Section 3 and conditioned thereon, Tenant’s interest in the Sublease and all rentals and income arising therefrom, subject to the terms of this Section 3. Landlord, by consenting to the Sublease Sublease, agrees that until a default shall occur in the performance of Tenant’s obligations under the Lease, Tenant may receive, collect and enjoy the rents accruing under the Sublease. In ; provided, however, in the event Tenant shall default be in Default (beyond any applicable notice and cure periods) in the performance of its obligations to Landlord under the Lease, then whether or not Landlord terminates may, at its option by notice to Tenant, elect to receive and collect, directly from Subtenant, all rent and any other sums owing under the Sublease, to the extent of the rent and any other sums due under the Lease, all as further set forth in Section 3.1, below. In the event that the Lease shall be terminated, Landlord may, at its option by notice to Tenant, either (i) terminate the Sublease, or (ii) elect to receive and collect, directly from Subtenant, all rent and any other sums owing and to be owed under the Sublease, as further set forth in Section 3.l below, or (iii) elect to succeed to Tenant’s interest in the Sublease and cause Subtenant to attorn to Landlord, as further set forth in Section 3.2 3.2, below.

In the event Tenant shall default in the performance of its obligations to Landlord under SECTION 19.1 of the Lease, then Lease (whether or not Landlord terminates the Lease), however, Landlord may, in connection with SECTION 19.3 of the Lease, at its option by notice to Tenant, either (i) terminate the Sublease, (ii) elect to receive and collect, directly from Subtenant, all rent and any other sums owing and to be owed under the Sublease, as further set forth in Section 3.l SECTION 3.1, below, or (iii) elect to succeed to Tenant’s 's interest in the Sublease and cause Subtenant to attorn to Landlord, as further set forth in Section 3.2 SECTION 3.2, below.
