Common use of Remedy Limitation Clause in Contracts

Remedy Limitation. All disputes, controversies or claims arising out of or relating to this Agreement or the breach, termination or validity thereof ("Dispute") brought by a third party beneficiary to this Agreement shall be exclusively and finally settled in accordance with the dispute resolution mechanism set forth in Article VI. In the event of a Dispute regarding the availability of third party benefits, no third party benefits provided by this Agreement shall be available to any third party beneficiary who pursues any form of dispute resolution inconsistent with the dispute resolution mechanism set forth in Article VI.
