Replacing Future Benchmarks Sample Clauses
The "Replacing Future Benchmarks" clause establishes a process for substituting a financial benchmark referenced in an agreement if that benchmark becomes unavailable or is no longer representative. Typically, this clause outlines the criteria and procedures for selecting a new benchmark, such as using a pre-identified alternative or following a specified decision-making process involving the parties. Its core practical function is to ensure continuity and certainty in contractual obligations by providing a clear method for updating benchmarks, thereby minimizing disruption and disputes if the original benchmark is discontinued or altered.
