The Indenture Trustee makes no representation or warranty as to the correctness of any statement, recital or representation made by any Person other than the Indenture Trustee in this Supplemental Indenture No. 3, any other Transaction Document or the Refunding Notes or, except with respect to the due authentication by the Indenture Trustee of the Refunding Notes, as to the validity or sufficiency of this Supplemental Indenture No. 3 or the Refunding Notes.
