Common use of Rest Period Following Overtime or Call Clause in Contracts

Rest Period Following Overtime or Call. Out (i) Except as outlined in sub-section (ii) and (iii), employees working overtime or call-out which ends within eight (8) hours of their next regularly scheduled shift shall receive eight (8) consecutive hours time off without loss of pay. (ii) Employees on call-out shall receive eight (8) consecutive hours time off without loss of pay unless the call-out commenced three (3) hours or less from the start time of their regularly scheduled shift. (iii) Employees on call-out for snow clearing shall receive eight (8) consecutive hours time off without loss of pay unless the call-out commenced four (4) hours or less from the start time of the regularly scheduled shift. (iv) Sub-section (ii) and (iii) applies only if the number of hours the employee works exceeds two (2) hours.
