Restriction on Marketing Activity. Except for marketing representatives designated in writing by Service Provider to DIR, none of the Service Provider Personnel shall conduct any marketing activities to the State, DIR or any DIR Customer at DIR Facilities (including marketing of any New Services), other than, subject to Section 13.1, reporting potential marketing opportunities to Service Provider's designated marketing representatives.
Restriction on Marketing Activity. Except for marketing representatives designated in writing by Supplier to Kraft, none of the Supplier Personnel shall conduct any marketing activities to Kraft or Eligible Recipient employees at Kraft Facilities or sites (including marketing of any New Services), other than, subject to Section 13.3, reporting potential marketing opportunities to Supplier’s designated marketing representatives.
Restriction on Marketing Activity. Except for marketing representatives expressly agreed to by HP-OMS and Customer, none of the HP-OMS Personnel performing Services for Customer hereunder shall conduct, without the prior written consent of Customer, any sales or marketing activities directed at Customer or any third party, at any Customer Site or any other location, for as long as such HP-OMS Personnel are engaged in the provision of Services to Customer.
Restriction on Marketing Activity. Except for the Supplier Project Executive, none of the Supplier Personnel shall conduct any marketing activities at ABM, other than reporting potential marketing opportunities to Supplier’s designated marketing representatives. In addition, except for the Supplier Personnel occupying the positions designated with an asterisk in Schedule C, in no event shall Supplier pay any Supplier Personnel engaged in performing or delivering Services under this Agreement (including, for example, business aligned service delivery managers or service delivery executives), any incentive compensation or bonuses based upon revenue from sales to ABM or any other Eligible Recipient. For the avoidance of doubt, nothing in this provision is intended to compromise Supplier’s Employee Performance Bonus program or the Supplier executive incentive bonus program which consider total IBM and IBM Global Services revenue.
Restriction on Marketing Activity. Except for marketing representatives designated in writing by Supplier to Triad, none of the Supplier Personnel shall conduct any marketing activities to Triad or Eligible Recipient employees at Triad Facilities or Sites (including marketing of any New Services), other than, subject to Section 13.3, reporting potential marketing opportunities to Supplier’s designated marketing representatives.
Restriction on Marketing Activity. Except for marketing representatives designated in writing by Service Provider to TxDOT, none of the Service Provider Personnel shall conduct any marketing activities to the State or TxDOT at TxDOT Sites (including marketing of any New Services), other than, subject to Section 13.1, reporting potential marketing opportunities to Service Provider's designated marketing representatives.
Restriction on Marketing Activity. Except for marketing representatives designated in writing by Provider to Client and activities expressly approved in advance by Client, none of the Provider Personnel shall conduct any marketing activities to Eligible Recipient employees or agents (including marketing of any New Services), other than reporting potential marketing opportunities to Provider’s designated marketing representatives. Under no circumstances shall Provider use information provided by Client specifically or in the aggregate to advertise or market itself or others. In addition, Provider shall not use or access queries, searches, Client Data, Client Confidential Information, Personal Data or metadata for any secondary uses beyond the limited extent necessary to provide the Services to Client and the other Eligible Recipients. For the avoidance of doubt, Provider shall not use any such information, queries, searches, Client Data, Client Confidential Information, Personal Data or metadata for marketing or market research purposes.
Restriction on Marketing Activity. Except for marketing representatives designated in writing by Provider to Xxxxxxxx, none of the Provider Personnel shall conduct any marketing activities to Xxxxxxxx or Eligible Recipient employees at Xxxxxxxx Facilities or Xxxxxxxx Sites (including marketing of any New Services), other than, subject to SECTION 13.3, reporting potential marketing opportunities to Provider's designated marketing representatives.
Restriction on Marketing Activity. Except for marketing representatives designated in writing by Supplier to Hercules, none of the Supplier Personnel shall conduct any marketing activities to Hercules or Eligible Recipient employees at Hercules Facilities or Hercules Sites (including marketing of any New Services), other than reporting potential marketing opportunities to Supplier’s designated marketing representatives.
Restriction on Marketing Activity. Except for marketing representatives designated in writing by Supplier to Allianz, none of the Supplier Personnel shall conduct any marketing activities to Allianz or Eligible Recipient employees at Allianz Facilities or Allianz Sites (including marketing of any New Services), other than reporting potential marketing opportunities to Supplier’s designated marketing representatives.
