Restrictions on Applera. In connection with the Maui Project, Applera shall not: (i) supply or OEM any instrument resulting from the Maui Project to Abbott other than through the Abbott Alliance; or (ii) commercialize the Maui Assays for a period of three (3) years following the Effective Date, subject to Section 3.9 hereof.
