Retention of possession. (a) Subject to any requirement of law, Viterra will be entitled, for the purpose of enforcing such lien or Security Interest, to:
(i) retain possession of the whole or any part of the Client’s Grain until all amounts due and payable are paid; or
(ii) sell all or any of the Client’s Grain in such manner as it thinks fit (after giving the Client at least 5 Business Days prior notice). The proceeds of any sale will be applied towards the satisfaction of the moneys due to Viterra or any other Viterra Group Company and the costs of effecting the sale, and the balance (if any) will be paid by Viterra to the Client.
(b) If Viterra sells all or any of the Client’s Grain for the purpose of enforcing its lien or Security Interest, the Client irrevocably appoints Viterra as its agent and attorney for this purpose.
Retention of possession. Notwithstanding the appointment of any receiver, liquidator or trustee of Borrower, or any of its property, or of the Property or any part thereof, Lender, to the extent permitted by law, shall be entitled to retain possession and control of all property now or hereafter granted to or held by Lender under this Security Instrument.
Retention of possession. Notwithstanding the appointment of any ----------------------- receiver, liquidator or trustee of the Mortgagor, or any of its property, or of the Trust Estate or any part thereof, the Beneficiary or the Jurisdictional Trustee, as applicable, to the extent permitted by law, shall be entitled to retain possession and control of all property now or hereafter granted to or held by the Beneficiary or the Jurisdictional Trustee, as applicable, under this Mortgage.

Subject to any requirement of law, the Company will be entitled, for the purpose of enforcing such lien or security interest, to retain possession of the whole or any part of the Client’s Bulk Wheat until all amounts due and payable are paid, or to sell all or any of the Client’s Bulk Wheat in such manner as it thinks fit (after giving the Client at least 7 days prior notice) whereupon the proceeds of such sale will be applied in or towards the satisfaction of the moneys due to the Company or any other Viterra Group Company and the costs of effecting the sale, and the balance (if any) will be paid by the Company to the Client. Where the Company sells all or any of the Client’s Bulk Wheat for the purpose of enforcing its lien or security interest, the Client irrevocably appoints the Company as its agent and attorney for such purpose.

Notwithstanding the appointment of any receiver, liquidator or trustee of Mortgagor, or of the Premises or any part thereof, Mortgagee shall be entitled to retain possession and control of all property now or hereafter granted, bargained, sold, mortgaged, warranted, conveyed, pledged and/or assigned to or held by Mortgagee under this Mortgage.

Subject to any requirement of law, the Company will be entitled, for the purpose of enforcing such lien, to retain possession of the whole or any part of the Client’s Bulk Wheat until all amounts due and payable are paid, or to sell all or any of the Client’s Bulk Wheat in such manner as it thinks fit (after giving the Client at least 7 days prior notice) whereupon the proceeds of such sale will be applied in or towards the satisfaction of the moneys due to the Company and the costs of effecting the sale, and the balance (if any) will be paid by the Company to the Client. Where the Company sells all or any of the Client’s Bulk Wheat for the purpose of enforcing its lien, the Client irrevocably appoints the Company as its agent and attorney.

Retention of possession. The provisions of this Section do not (a) waive the Landlord's rights of reentry or any other right hereunder, and (b) obligate Landlord to negotiate with Tenant regarding the holdover rental rate or any other condition of a holdover tenancy.
