RETURN SHIPMENTS. (1) Return shipments of radioactive substances can be conducted for the purpose of retrieval (including disposal, exploitation or recycling) or based on complaints. The Company only acts as a broker for recycling for selected sources after provision of the associated certificate for the source. The sources must be sealed and free of contamination. (2) Taking back sources for recycling as per (1) Sentence 1 is only possible for sources for which the Company or one of their legal predecessors is the distributing company. The Company is obliged to take back sealed sources. Following: - The French Public Health Code, R. 1333-52 and L. 1333-7, and - Our authorization number F005001 issued by the ASN. (3) Prior written consent is required for the return shipment, which takes place at the customer’s own risk and expense. The customer must give notice of an appropriate deadline agreed with the Company prior to shipping radioactive substances. The customer is obliged to ensure, that his declaration of the radioactive substances to be returned are in compliance with the acceptance criteria of the Company. For the purpose of Compliance with the relevant dangerous goods regulations the customer is solely responsible for the correct declaration of the radioactive substances to be returned – he is obliged to ensure the conformity of the declaration with the applicable law. This Responsibility of the customer includes especially the correct classification of the radioactive substances, the legally admissible packaging and it’s labeling as well as the documentation compliant to the relevant dangerous goods regulations. The customer is liable for the correctness and completeness of the information provided as well as for any damages caused by incorrect or incomplete information. (4) Return shipments received by the Company without prior written consent or without prior notification as per (3) will be returned through the Company at the sender’s expense. Alternatively, the Company can store the radioactive substances in a shipping warehouse at the customer's expense. The Company is entitled to charge the customer a processing fee for the processing of the return shipment and for any necessary quality control checks. (5) Suitable and authorized packaging must be used for returning radioactive substances. The customer may also request suitable packaging from the Company for the shipment and use this for shipping. RETURN SHIPMENTS. 18.1 Return shipments without prior permission in writing by HIT Trading are not permitted. 18.2 HIT Trading is in the case set forth in section 18.1 entitled to store the goods for the risk and the account of the Buyer at third parties or to keep these itself at the Buyer’s disposal. 18.3 Return shipments do not relieve the Buyer in any way of his payment obligations regarding the invoice for the delivered goods to which the return shipment relates, as well and for possible invoices for other products (delivered or yet to be delivered). 18.4 Regarding the actual costs from or relation to return shipments and those deriving from the measures taken by HIT Trading, its specified overview is binding for the Buyer, unless proved to the contrary. 18.5 Return shipments are always for the risk of the Buyer and should be sent without charge to HIT Trading stating the sales order number.
RETURN SHIPMENTS. 8.1 With the exception of a justified cancellation of the Contract the Buyer shall not be entitled to return any Products to VICTREX without the explicit written consent by VICTREX.

RETURN SHIPMENTS. We will also pay for covered direct physical loss or damage to outgoing shipments that have been rejected by the consignee or are not deliverable, while being returned to you.
RETURN SHIPMENTS. 14.1 If the customer wishes to return certain parts or machines for any reason, he must notify this in writing in advance. Only returns that have been expressly approved by Lightwing in advance will be accepted. For other shipments, Lightwing reserves the right not to accept them and to return them at the expense of the sender, to invoice the returned parts or machines properly or (in the case of advance payment) to waive a credit note to the customer. 14.2 Electronic assemblies called Electrostatically Endangered Components or ESD (Electronic Sensitive Device) can be destroyed by electrostatic charging. These parts are only to be shipped, transported and stored in special packaging that complies with ESD. For parts received by Lightwing in unsuitable packaging, the buyback will be rejected. 14.3 The customer must return replacement parts as well as deliveries and services from warranty claims within 90 days of the date of notice. If Purchaser allows this period to elapse unused, Lightwing reserves the right to refuse acceptance of such parts or machines and to return them at Purchaser's expense or, if applicable, to invoice them properly or (in the case of advance payment) to waive a credit note to Purchaser.

The source must be tightly sealed and provided with a valid leak test certificate as well as free of contamination. (2) Taking back sources as per (1) Sentence 1 is only possible for sources for which the Company or one of their legal predecessors is the distributing company. The Company is not obliged to take back sources. Sentence 2 does not apply to highly radioactive radiation sources. If country-specific statutory obligations to take back sources exist, Sentence 2 does not apply. (3) Prior written consent is required for the return shipment, which takes place at the customer’s own risk and expense. The customer must give notice of an appropriate deadline agreed with the Company prior to shipping radio- active substances. (4) Return shipments received by the Company without prior written consent or without prior notification as per (3) will be returned at the sender’s expense. Alternatively, the Company can store the radioactive substances in a shipping warehouse at the customer's expense. The Company is entitled to charge the customer a processing fee for the processing of the return shipment and for any necessary quality control checks. (5) Suitable and authorized packaging must be used (preferably the packag- ing used by the Company for delivery) for returning radioactive substances. The customer may also request suitable packaging from the Company for the shipment and use this for shipping. The Company is entitled to charge the customer a fee for the loan of suitable packaging. Proof of the suitability of the packaging must be provided by the customer and must be confirmed by the Company in writing. (6) The customer bears the costs and risks associated with the return ship- ment.
