Common use of Return to Work After Maternity Leave Clause in Contracts

Return to Work After Maternity Leave. (a) An officer shall confirm her intention of returning to work by notice in writing to the employer given not less than four weeks prior to the expiration of her period of maternity leave. (b) An officer, upon returning to work after maternity leave or the expiration of the notice required by paragraph (a) of this subclause, shall be entitled to the position which she held immediately before proceeding on maternity leave or, in the case of any officer who was transferred to a safe job pursuant to subclause (6) of this clause, to the position which she held immediately before such transfer or, in relation to an officer who has worked part time during the pregnancy, the position she held immediately before commencing such part time work. Where such position no longer exists but there are other positions available which the officer is qualified for and is capable of performing, she shall be entitled to a position as nearly comparable in status and pay to that of her former position.

Where such position no longer exists but there are other positions available which the officer employee is qualified for and is capable of performing, she shall be entitled to a position as nearly comparable in status and pay to that of her former position.
