Review and Disclaimer. NYSERDA’s execution of this Agreement with the Contractor and any NYSERDA review of the design, construction, operation, or maintenance of the Project shall not constitute any representation as to the economic or technical feasibility, operational capability, or reliability of the Project or Facility. The Contractor shall in no way represent to any third party that NYSERDA’s execution of this Agreement or any reviews by NYSERDA, including, but not limited to, NYSERDA’s review of the design, construction, operation, or maintenance of the Project is a representation by NYSERDA as to the economic or technical feasibility, operational capability, or reliability of the Facility or Project.
Review and Disclaimer. Program Administrator’s review of the design, construction, installation, operation or maintenance of the Project or the SG Unit(s) is not a representation as to their economic or technical feasibility, operational capability, or reliability. Applicant and Host Customer each agrees that neither of them will make any such representation to any third party. Applicant and Host Customer are solely responsible for the economic and technical feasibility, operational capability, and reliability of the Project and the SG Unit(s).
Review and Disclaimer. 9.1 Review by Edison of the design, construction, operation, or maintenance of Seller's Interconnection Facilities or as to the economic or technical feasibility, operational capability, or reliability of such facilities. Seller shall in no way represent to any third party that any such review by Edison of such facilities including but not limited to any review of the design, construction, operation, or maintenance of such facilities by Edison is a representation by Edison as to the economic or technical feasibility, operational capability, or reliability of such facilities. 9.2 Edison shall notify Seller in writing of the outcome of Edison's review of the design and all of the specifications, drawings, and explanatory material for Seller's Interconnection Facilities (and the Generating calendar days of the receipt of the design and all of the specifications, drawings, and explanatory material for Seller's Interconnection Facilities (and the Generating specifications, drawings, and explanatory material for Seller's Interconnection Facilities (and the Generating Edison's written notification.
Review and Disclaimer. 9.1 Review by PG&E of the design, construction, operation, or maintenance of Seller's Interconnection Facilities except Special Facilities or Generating Facility shall not constitute any representation as to the economic or technical feasibility, operational capability, or 25 reliability of such facilities. Seller shall in no way represent to any third party that any such review by PG&E of such facilities including but not limited to any review of the design, construction, operation; or maintenance of such facilities by PG&E is a representation by PG&E as to the economic or technical feasibility, operational capability, or reliability of such facilities. Seller is solely responsible for economic and technical feasibility, operational capability, and reliability of Seller's Interconnection Facilities except Special Facilities and the Generating Facility.
9.2 PG&E shall notify Seller in writing of the outcome of PG&E's review of the design and all of the specifications, drawings, and explanatory material for Seller's Interconnection Facilities except Special Facilities (and the Generating Facility, if requested by PG&E) within thirty (30) calendar days of the receipt of the design and all of the specifications, drawings, and explanatory material for Seller's Interconnection Facilities (and the Generating Facility, if requested by PG&E). Any flaws in the design perceived by PG&E in the review of all of the specifications, drawings, and explanatory material for Seller's Interconnection Facilities (and the Generating Facility, if requested by PG&E) shall be described in PG&E's written notification.

SDG&E’S AND/OR ITS CONSULTANTS’ REVIEW OF THE DESIGN, CONSTRUCTION, OPERATION OR MAINTENANCE OF THE PROJECT OR DEMAND RESPONSE MEASURES (“DRMs”) SHALL NOT CONSTITUTE ANY REPRESENTATION AS TO THE ECONOMIC OR TECHNICAL FEASIBILITY, OPERATIONAL CAPABILITY, OR RELIABILITY OF THE PROJECT OR DRMs, NOR SHALL CUSTOMER, IN ANY WAY, MAKE SUCH A REPRESENTATION REGARDING SDG&E’S REVIEW TO A THIRD PARTY. CUSTOMER IS SOLELY RESPONSIBLE FOR THE ECONOMIC AND TECHNICAL FEASIBILITY, CONSTRUCTION, OPERATIONAL CAPABILITY AND RELIABILITY OF CUSTOMER’S PROJECT AND EEMs. SDG&E MAKES NO WARRANTY, CONCERNING THE PROGRAM, THE INCENTIVES, THE PROJECT OR THE DRMs, WHETHER STATUTORY, EXPRESS OR IMPLIED, INCLUDING, WITHOUT LIMITATION, THE IMPLIED WARRANTY OF MERCHANTABILITY AND FITNESS FOR ANY PARTICULAR PURPOSE, USE OR APPLICATION.

(Utility’s) review of the design, construction, operation, or maintenance of the Project Sponsor’s Project or EEMs shall not constitute any representation as to the economic or technical feasibility, operational capability, or reliability of the Project EEMs. The Project Sponsor shall in no way represent to any third party that (Utility’s) review of the EEMs or Project, including, but not limited to, (Utility’s) review of the design, construction, operation, or maintenance of the EEMs or Project, is a representation by (Utility) as to the economic or technical feasibility, operational capability, or reliability of such EEMs or Project. The Project Sponsor is solely responsible for the economic and technical feasibility, operational capability, and reliability of Project Sponsor’s Project and EEMs.
Review and Disclaimer. By NYSERDA’s execution of this Agreement with the Contractor, neither NYSERDA nor the State of New York: (1) endorse the Contractor, any fuel cell manufacturer, or fuel cell system; or

Awardee shall in no way represent to any third party that the Commission’s review of Awardee’s project is a representation by the Commission as to the project’s economic or technical feasibility, operational capability, or reliability. Awardee is solely responsible for its project’s economic and technical feasibility, operational capability, and reliability.
