Rewrites. If Writer so elects, Company shall be required to employ the Writer to perform the first rewrite. Compensation for the rewrite is subject to negotiation between Company and the Writer, provided, however, that it shall be no less than MBA minimum. The Company and the Writer may also agree to defer partial or full payment for the rewrite if performed by the Writer and on terms equal to or more favorable than those for the person who performs directing services. If a rewrite is performed, Company shall pay contributions to the Producer-Writers Guild of America Pension Plan Writers' Guild- Industry Health Fund on both the screenplay purchase price and the rewrite compensation in accordance with MBA Articles 17 and 71. The minimum compensation for a rewrite of a spec script written between September 25, 2023 and May 1, 2024 is $28,957. Company and the Writer have agreed to defer payment of $ of the compensation for the first rewrite. If no rewrite is elected, please indicate “N/A.” Company will pay Writer for any additional writing services pursuant to the terms of the MBA then in effect. If Company fails to pay the Screenplay Compensation and/or rewrite compensation to the Writer when due, Company shall pay interest at the rate of one- and one-half percent (1.5%) per month on all outstanding amounts until paid in full.

Rewrites. Virtually every student- and professional film-score will require some kind of rewrite. Some cues will need a minor tweak, but if more than a third of the score is being significantly rewritten, a communication breakdown has occurred. This means that the time is ripe to create a different approach to getting the filmmaker’s ideas understood so that the music can successfully support the emotional needs of the picture. • No more than 2 rewrites per cue can be requested of the composer. And the final such request cannot be made later than 3 days prior to the scoring session, or, if there is no scoring session, 4 days prior to the dub. The rationale for this rule is this: The time spent composing the cues often comprises less than half of the entire scoring schedule. The remainder of the time, the composer is developing themes and styles, orchestrating, preparing pre-records and scoring files, as well as editing and mixing. If live musicians are used, a substantial amount of time also is spent recruiting players and creating printed parts for them to use at the session.
Rewrites. In the event the apprentice fails to pass an examination in either one of the 4th, 3rd or 2nd classifications the Company will allow an additional 6 months per Operating Engineer Classification for a rewrite of one exam per classification. If the apprentice is unable to pass a rewrite in any one of the classifications then he/she shall be removed from the Apprenticeship Program and returned to the Labour Pool.

  • Supplier Staff The Supplier Staff shall at all times during the Contract Period; obey all lawful instructions and reasonable directions of the Customer; apply all due skill, care, diligence and shall be appropriately experienced, qualified and trained to supply the Services in accordance with this Contract; and shall respond to any enquiries from the Product Owner relating to the Services within the timescales agreed by the Parties (where applicable) and in any event as soon as is reasonably practicable. The Supplier acknowledges and agrees that the continuity of the Key Personnel is paramount to the success of the Project and shall ensure that Key Personnel are assigned to the Project on a full-time basis and are not removed from the Services or assigned to any other Supplier or third party projects during the Contract Period (unless otherwise Approved by the Customer). The Customer may also require the Supplier to remove and/or replace any Key Personnel that the Customer acting reasonably considers in any respect unsatisfactory. The Customer shall not be liable for the cost of removing or replacing any Key Personnel. The Customer may, by written notice to the Supplier, refuse to admit onto, or withdraw permission to remain on, the Customer’s Premises any member of the Supplier Staff or any person employed or engaged by any member of the Supplier Staff whom the Customer believes represents a security risk or does not have the required levels of training and expertise or whose admission or continued presence would, in the reasonable opinion of the Customer, be undesirable. Supplier Staff engaged within the boundaries of the Customer’s Premises shall comply with such rules, regulations and requirements as may be in force from time to time for the conduct of personnel when at or within the boundaries of those Customer’s Premises.

  • Updates and Upgrades Contractor grants to the Department a non-exclusive, non-transferable license to use upgrades and updates provided by Contractor during the term of the Contract. Such upgrades and updates are subject to the terms of the Contract. The Department shall download, distribute, and install all updates as released by Contractor during the length of the Contract, and Contractor strongly suggests that the Department also downloads, distributes, and installs all upgrades as released by Contractor during the length of the Contract. Contractor shall use commercially reasonable efforts to provide the Department with work-around solutions or patches to reported software problems that may affect the Department’s use of the software during the length of the Contract.

  • Scope of Grievances A. A grievance may be filed if a management interpretation or application of the provisions of this Memorandum of Understanding adversely affects an employee's wages, hours or conditions of employment.
