Right to Refuse or Stop Unsafe Work. The Union shall have the right to stop any work considered unsafe or hazardous. No employee shall be discharged, penalized or disciplined for refusing to work on a job or in any workplace or to operate any equipment where they or a member of the Union believes that it would be unsafe or unhealthy to themselves, an unborn child, a workmate or the public, or where it would be contrary to the applicable federal, provincial or municipal health and safety legislation or regulations. There shall be no loss of pay during the period of refusal. No employee shall be ordered or permitted to work on a job which another employee has refused until the matter is investigated by the Union and the Employer and satisfactorily settled.

Right to Refuse or Stop Unsafe Work. No employee shall be required to work at a job site which the employee has indicated is unsafe until such time that the site has been declared safe following inspection by a representative from the Workers' Compensation Board or representatives from the District Occupational Health & Safety Committee accompanied by the District Health & Safety Officer. Within twenty-four (24) hours of claiming the work site is unsafe the employee shall file with the School Board a report outlining the rationale for the claim.
