RIGHT TO SEEK EQUITABLE RELIEF. Notwithstanding any other provision of this Section, either Party may bring suit in a court of competent jurisdiction for equitable relief from the other Party’s alleged breach of its confidentiality obligations without first mediating or arbitrating the issue.
