Common use of Rights and Duties of the Common Representative Clause in Contracts

Rights and Duties of the Common Representative. (a) The Common Representative shall have the duties, rights and authorities set forth in the LMV and LGTOC (including, without limitation, those included in Article 68 of the LMV), in the Global Certificate and in this Agreement. If not expressly provided for in the Global Certificate, in this Agreement or in the LMV and/or LGTOC, the Common Representative shall act pursuant to the instructions of the Holders Meeting. The Common Representative represents the Holders as a whole and not any one of them individually.
