Common use of Rights on Layoff Clause in Contracts

Rights on Layoff. Upon receipt of a layoff notice, an Employee may: (a) move into a vacant position for which her or she has the ability to perform the work; or (b) if no such vacancy exists, displace the least senior Employee in his or her classification; or (c) if no such Employee exists, displace the least senior Employee in another classification from a position for which she has the qualifications or ability to perform the work; or (d) if no such Employee exists, accept the layoff. A laid off employee shall not be required to displace into a position that has a lower FTE. A laid off employee shall not be permitted to displace into a position that has a higher FTE.
