Safety and the Environment. Except where otherwise agreed by the Company the Boat Owner shall at all times maintain valid Boat Safety Scheme certification for the Vessel if that Vessel is moored or navigates above Hall Bridge on the Navigation. The Boat Owner agrees to pay an additional administration charge of £50 for each quarter in which current Boat Safety Scheme certification is not held for a period of 30 days or more for any boat that moors or navigates (for however short a period) above Hall Bridge.

Safety and the Environment. Without limiting its other obligations under this Contract or otherwise at law (including under the WHS Law), when carrying out the Services, the Consultant must: (a) if it becomes aware of the existence or possibility of any work health, safety and environmental issues (including any potential breach of any WHS Laws) in connection with the Services, notify the City immediately (and in any event within 12 hours of such matter arising) of the Consultant becoming so aware; (b) if applicable, ensure that all Personnel have undertaken any required induction as directed by the City; and (c) as necessary, consult, cooperate and coordinate activities with the City and any other persons who have a common duty under the WHS Law.
Safety and the Environment. In the event of any spillage (which for the purpose of this Clause shall mean any leakage, escape, or overflow of the Marine Fuels) causing or likely to cause pollution occurring at any stage of the bunkering operation, the Buyer or the Seller shall jointly, and regardless as to whether the Buyer or the Seller is responsible, immediately take such action as is necessary to effect clean up and which shall always be conducted in accordance with such local laws and regulations which may compulsorily apply.

The Hardware must be adequately packed and must be marked in accordance with statutory instructions, decrees and any other additional regulations of the Principal, to ensure that they reach their destination in good condition. All packaging and/or packaging material will be taken back by the Supplier upon delivery or, insofar as applicable, upon Installation, or insofar as otherwise agreed in Appendix VAdditional Agreements. 2. If the Principal wishes to be rid of the Hardware, the Supplier will be required to take it back in accordance with the AEEA Directive and to process it or cause it to be processed. The processing of the discarded electrical and electronic Hardware taken back must take place using the best available techniques. 3. If the Principal wishes to sell the Hardware or to give it to a third party, the Principal must inform the Supplier accordingly in writing and immediately. Also, if applicable, the Principal may not pass on the Software to any third party without the Supplier’s prior written consent.
Safety and the Environment. 10.1 The Buyer shall be responsible and shall be obliged to apply all positive regulations, rules, and provisions of deeds related to Vessels, as well as all laws and bylaws of the Republic of Austria and by the country of its registration, whichever is more stringent, – governing fire prevention, sanitary protection, environmental protection, as well as undertaking activities in terms of prevention and remediation of environmental contamination by Marine Fuel. 10.2 If, at any time prior to or during delivery, Seller reasonably determines that the circumstances for delivery are unsafe or have the potential for a spill occurring due to conditions such as, but not limited to, unsafe or inadequate working environment, practices or procedures, facilities, tools or equipment, incompatible configurations or bad weather, Seller reserves the right not to commence delivery or to terminate the supply immediately without any prior notice to Buyer and without liability. Buyer shall be solely responsible for any loss or damage occurring on board or to the Vessel resulting from any incident arising out of or in connection with any such conditions. 10.3 By purchasing Marine Fuels from Seller, Buyer warrants that it is familiar with the health effects related to Marine Fuels supplied hereunder and with relevant protective safety and health procedures for the handling and use of such Marine Fuels. Buyer shall adhere to such safety and health procedures while using or handling Marine Fuels. Buyer shall also facilitate the dissemination of health and safety information to all employees, users, and others potentially exposed to Marine Fuels sold hereunder. Buyer shall be responsible for compliance by its employees, agents or contractors, and other users with all health and safety requirements or recommendations related to Marine Fuels supplied hereunder and shall exert its best efforts to assure that any of its employees or agents, users, and others avoid frequent or prolonged contact with or exposure to Marine Fuels both during and subsequent to delivery. Seller or Seller’s supplier accepts no responsibility for any consequence arising from failure by Buyer, its employees, agents, contractors, any users, or any other party to comply with relevant health and safety requirements or recommendations relating to such contact or exposure. 10.4 If a spill occurs while Marine Fuels are being delivered, Buyer and Seller shall promptly take such action as is reasonably necessary to co...

Safety and the Environment. 9.1 ESS shall, at all times maintain safe working conditions and comply with all relevant occupational health and safety and environmental laws and regulations. 9.2 ESS shall immediately notify the Company of any incident in respect of safety or environmental conditions at the Site. 9.3 Without limiting the generality of clauses 9.1 and 9.2, ESS shall strictly comply with any directions or procedures of the Superintendent or the Company on occupational health and safety and environmental issues, including any additional requirements set out in this Contract.
Safety and the Environment. 9.1 Lessor shall execute the construction safely and so as to protect persons and property. The Lessor shall be responsible for securing insurance for the General Contractor, subcontractors and property insurance for the expansion facility. The Lessee shall be responsible for insurance for its employees. 9.2 If Lessee reasonably considers there is a risk of injury to people or damage to property arising from the construction, Lessee may direct Lessor to change its manner of working or to cease working. 9.3 Lessor shall 9.3.1 ensure that in executing the construction: (a) it complies with all Legislative Requirements and other safety and security requirements of Lessee for occupational health, safety and rehabilitation management, including but not limited to, use of safety harnesses, proper eye protection and use of safe lift equipment. Lessor shall stop construction until correction is made when the Engineering Firm reports any infraction to the code and regulation. Lessee will not allow the Lessor’s worker to enter the ground when they repeatedly violating safety codes and regulations.; (b) it keeps grounds and construction area free of debris and waste materials and equipment stored in a neat manner when not in use. (c) all of its workers on site of Lessee shall sign in and out daily according to the rules of Lessee and living on the premises will not be allowed. Its workers will not be allowed to enter into any Lessee’s physical plant or support systems without Lessee’s written approval. (d) Tie-ins to existing Lessee operating systems, including but not limited to the electrical system, fire system, compressed air, any gas system, water, shall be coordinated with Lessee’s staff and written permission granted by Lessee scheduling the time and duration of the tie-in. In no event will any utility or system be shut down or otherwise disabled without the express written approval of Lessee. Lessor shall be responsible for loss or damages to equipments, tooling, production product or personnel that result from interrupted utility caused by it. (e) it shall procure its own sources of water and electricity during the construction and not use Lessee’s sources without written permission in advance. (f) Any damage caused by Lessor or its various sub-contractors to the existing building, grounds, roads, systems, equipments or any facility of Lessee shall be repaired at Lessor’s cost. Associates are expected to observe all safety rules and practices and to follow instructions concerning safe and efficient work practices. All employees should advise their supervisor or other management representatives immediately if they see a work practice or activity they consider to be conducted in an unsafe or careless manner.
