Safety Disputes Procedure. Where a safety problem exists, an inspection of the area shall be made by a member of the PPW project Management Team together with the safety Committee Chairperson, and/or the Employees elected safety representative if deemed necessary. The safety committee shall consist of an equal number of PPW management and employees. The Employee safety representative shall be an employee of PPW. The Safety Chairman shall be a member of the safety committee. Any safety measure that needs to be taken or any remedial action required on existing safety structures or devices of any sort shall be rectified in one of the following ways: • Fixed on the spot by the Employees safety representatives, or others as directed; or • Listed for urgent rectification. If it is necessary to relocate any Employee(s) who are working in the unsafe area to a safe area or another site, the PPW representative will do so immediately. Should the PPW representative consider that no action is necessary he/she shall discuss the matter with the Site Safety Chairperson and/or Employees safety representative. If Agreement is not reached between the PPW representative and the Employees safety representative a Queensland Workplace Health and Safety Inspector may be called to the site to inspect the area and give his/her opinion. In such cases the Employees in the area will be relocated pending the Workplace Health and Safety inspection. Should a particular zone of the project be in dispute on the basis that Queensland Workplace Health and Safety Inspector declares the whole project unsafe, the parties commit to adhering to the following procedure. (a) PPW will nominate, in conjunction with the Site Safety Committee, the order of priority of the zones to be inspected by the Site Safety Committee and an immediate inspection of the project shall take place. (b) The inspection will identify the safety rectification work needed to take place in each zone. (c) As zones are agreed for rectification all Employees, who can gainfully be employed will immediately commence rectification works. (d) Upon verification that such rectification has been completed productive work will resume. The resumption of work will take place progressively as each zone has been cleared. It is specifically agreed that Employees will not leave the site without the approval of the Project Manager/Construction Manager - who in deciding whether to give approval shall liaise with the PPW elected safety representative.

Where an Employee becomes aware of an unsafe situation, the Employee must rectify the situation if it is within their competence and it is safe to do so and immediately report the matter to management.
