SCHEDULE OF WORK. FIRST PARTY’S proposed schedule for the various services required will be set forth in Exhibit A-1. In addition to services described in Section A1, the parties may from time to time agree in writing that FIRST PARTY, for additional compensation, shall perform additional services including but not limited to: • Change in the services because of changes in scope of the work. • Additional tasks not specified herein as required by the CITY. The CITY and FIRST PARTY shall agree in writing to any changes in compensation and/or changes in FIRST PARTY’s services before the commencement of any work. If FIRST PARTY deems work he/she has been directed to perform is beyond the scope of this agreement and constitutes extra work, FIRST PARTY shall immediately inform the CITY in writing of the fact. The CITY shall make a determination as to whether such work is in fact beyond the scope of this agreement and constitutes extra work. In the event that the CITY determines that such work does constitute extra work, it shall provide compensation to the FIRST PARTY in accordance with an agreed cost that is fair and equitable. This cost will be mutually agreed upon by the CITY and FIRST PARTY. A supplemental agreement providing for such compensation for extra work shall be negotiated between the CITY and the FIRST PARTY. SCHEDULE OF WORK. The Construction Manager shall commence work under this Agreement upon receipt of a Notice to Proceed, and shall prosecute the work diligently as described in Exhibit “A” in accordance with the schedule attached as Exhibit “C.” Time is of the essence and failure of Construction Manager to perform work on time as specified in this Agreement is a material breach of this Agreement.
SCHEDULE OF WORK. The dates of performance and schedule applicable to the provision of the Work under this Agreement will be provided in authorized Work Order. Contractor agrees that it shall provide the Services of the specified Work Order within the dates of performance and according to said schedule.

In no event shall the Architect be responsible for delays incurred by the District, Construction Managers or other agencies not directly under the Architect’s direction.
SCHEDULE OF WORK. The Criteria Architect must commence the Work under this Agreement upon execution and must prosecute the Work diligently as described in Exhibit B in accordance with the schedule attached as Exhibit D. Time is of the essence and failure of Criteria Architect to perform the Work on time as specified in this Agreement is a material breach of this Agreement.
SCHEDULE OF WORK. The schedule applicable to the provision of the Services under this Agreement is provided in Attachment 1 to Exhibit A – the contract schedule (“Contract Schedule”). Contractor agrees that it shall provide the Services of the specified Phase(s) according to said schedule. Firm start and completion dates will be inserted for each Phase as this Agreement is amended to authorize subsequent Phases.

SCHEDULE OF WORK. 4.1 Professional agrees to commence services upon written direction from City and to complete the tasks set forth in Exhibit A, Scope of Services, in accordance with a work schedule established by City (the “Work Schedule”), which is attached hereto and incorporated as Exhibit B. 4.2 In the event Professional’s performance of this Agreement is delayed or interfered with by acts of City or others, Professional may request an extension of time for the performance of same as hereinafter provided, and City shall determine whether to authorize any increase in fee or price, or to authorize damages or additional compensation as a consequence of such delays, within a reasonable time after receipt of Professional’s request. 4.3 No allowance of any extension of time, for any cause whatsoever, shall be claimed or made by Professional, unless Professional shall have made written request upon City for such extension not later than five (5) business days after the occurrence of the cause serving as the basis for such extension request, and unless City and Professional have agreed in writing upon the allowance of such additional time.

FIRST PARTY’s bills shall include the following information: A brief description of services performed, project title and the agreement number; the date the services were performed; the number of hours spent and by whom; the current contract amount; the current invoice amount; Except as specifically authorized by CITY, FIRST PARTY shall not xxxx CITY for duplicate services performed by more than one person. In no event shall FIRST PARTY submit any billing for an amount in excess of the maximum amount of compensation provided in Section A2. The expenses of any office, including furniture and equipment rental, supplies, salaries of employees, telephone calls, postage, advertising, and all other expenses incurred by FIRST PARTY in the performances of this agreement shall be incurred at the FIRST PARTY’s discretion.
