SCHOOL DISTRICT and COLLEGE. DISTRICT shall each take out and maintain during the life of this Agreement such liability insurance as shall protect each of them while performing work covered by this Agreement from any and all claims for damages and all operations under this Agreement, whether such operations be by either party or by any subcontractor or by anyone directly or indirectly employed by either of them.

SCHOOL DISTRICT and COLLEGE understand and agree that successful enrollment requires that each student has completed a COLLEGE enrollment application and that the application has been delivered to and accepted by COLLEGE’s Admissions and Registration Office, all applicable fees have been paid, including the standard COLLEGE student liability and medical care coverage, if applicable and the applicant has met all requirements for enrollment established by COLLEGE and PVCCD. DUAL-ENROLLMENT COURSES PVCCD is responsible for each DE Course and educational program, regardless of whether the DE Course and educational program is offered on site at the SCHOOL DISTRICT. The scope, nature, time, location, and listing of courses offered by a COLLEGE shall be determined by COLLEGE with the approval of PVCCD. The community college courses to be offered and criteria to assess the ability of pupils to benefit from those courses shall be established by PVCCD and set forth in the Course and Instruction Agreement Regarding Dual Enrollment (“Course and Instruction Agreement”). The Course and Instruction Agreement may be updated as required to reflect material changes in the information contained therein. All courses must be approved by the COLLEGE’s curriculum committee and be consistent with applicable law and approved by the PVCCD Board of Trustees. Courses offered at the SCHOOL DISTRICT shall be reviewed and approved by the SCHOOL DISTRICT through an approval process by which the SCHOOL DISTRICT through its designee shall review and approve the course and submit a request to the COLLEGE for review and consideration. COLLEGE shall review the request submitted by the SCHOOL DISTRICT and determine the DE courses to be offered in accordance with COLLEGE and PVCCD procedures and policies. Courses offered at the SCHOOL DISTRICT shall be of the same quality and rigor as those offered on COLLEGE campus and shall be in compliance with PVCCD academic standards. Courses offered at the SCHOOL DISTRICT shall be COLLEGE catalog courses with the same department designations, course descriptions, numbers, titles, and credits. Courses offered at the SCHOOL DISTRICT shall adhere to the official course outline of record and the student learning outcome established by the associated academic department within the PVCCD.
