Sediment Control. If applicable to the development, the Developer shall be responsible for providing, at its sole expense, grading, sediment control and storm water management measures as provided for by the Development Plan.
Sediment Control. Sediment control shall be accomplished using sediment traps, silt fences, settling ponds, or other methods as approved, in writing, by the Contract Administrator.

(1) For new development, the applicant shall design the stormwater management measures to retain soil particles greater than 5 microns on the site (80% reduction) resulting from a one-year 24-hour storm event (2.5 inches over 24-hour duration), according to approved procedures, and assuming no sediment resuspension.
(2) For redevelopment resulting in exposed surface parking lots and associated traffic areas, the applicant shall design the stormwater management measures to retain soil particles greater than 20 microns on the entire site (40% reduction) resulting from a one-year 24-hour storm event, according to approved procedures, and assuming no sediment resuspension. Under no circumstances shall the existing sediment control level or trapping efficiency of the site be reduced as a result of the redevelopment.
Sediment Control. Permittee shall implement Best Management Practices where sediment from project-related activities placed in upland areas might likely be washed into the stream. Sediment from project-related activities shall not be placed where it is likely to have a negative impact on native trees and vegetation.

1) Floodplain management coordination among all jurisdictions within the Southern Sarpy Watershed and the Papio-Missouri River Natural Resources District (P-MRNRD) is required.
2) Flood Insurance studies and mapping throughout the Southern Sarpy Watershed shall be updated using current conditions hydrology.

Purchaser shall be responsible for maintenance of erosion control devices within the Phase after the acquisition by Purchaser of the first Lot. In the event Purchaser is cited for violations by any governmental authority (unless such violation is caused by Seller or its agents, employees, contractors or subcontractors), the Purchaser shall, at its sole cost and expense, promptly endeavor to correct such violations and shall diligently correct same in a timely manner. Should Purchaser fail to do so, the Seller shall have the right, but not the obligation, to make such corrections and charge the cost to Purchaser. Should Seller be cited for violations in areas that are the responsibility of Purchaser by any governmental authority (unless such violation is caused by Seller or its agents, employees, contractors or subcontractors), Purchaser shall, at its sole cost and expense, promptly endeavor to correct such violations and shall diligently correct same in a timely manner. Should Purchaser fail to do so, the Seller shall have the right, but not the obligation, to make such corrections and charge the cost to Purchaser.
Sediment Control. Sediment control ponds and devices (during rough grading, installation of sewer and water utilities, storm drainage facilities and base paving activities only, and excluding those devices required for building construction), stormwater management facilities on the Project (including the Property), and temporary stabilization as required by appropriate authority, including maintenance of the same until grading is accepted by Purchaser, shall be Seller’s responsibility. All grading shall be in compliance with approved sediment control plans and site plans and all other governmental regulations.
