Common use of SEP Clause in Contracts

SEP. The Parties agree that the payment of the SEP Amount is a SEP, and that the SEP Amount will be treated as a suspended administrative civil liability for purposes of this Stipulated Order. Xxxxxxxx 66’s SEP obligations will be satisfactorily completed upon the San Francisco Estuary Institute’s written notification to Regional Water Board staff and Xxxxxxxx 66. The written notification shall acknowledge that the Regional Monitoring Program received payment of the SEP Amount from Xxxxxxxx 66 and the payment will be spent on the project described in Section III, paragraph 8(b) (i), in accordance with the terms of this Stipulated Order. The San Francisco Estuary Institute’s annual and quarterly financial reports to the Regional Water Board shall be considered a final post-project accounting of expenditures.

SEP. The Parties agree that the payment of the SEP Amount and the SEP Oversight Costs is a SEP, SEP and that the SEP Amount will be treated as a suspended administrative civil liability for purposes of this Stipulated Order. Xxxxxxxx 66Shell’s SEP obligations will be satisfactorily completed upon the San Francisco Estuary Institute’s written notification to Regional Water Board staff and Xxxxxxxx 66. The written notification shall acknowledge Shell acknowledging that the Regional Monitoring Program received payment of the SEP Amount and the SEP Oversight Costs from Xxxxxxxx 66 Shell and the payment will be spent on the project described in Section III, paragraph 8(b) (i13(b)(i), in accordance with the terms of this Stipulated Order. The San Francisco Estuary Institute’s annual and quarterly financial reports to the Regional Water Board shall be considered a final post-project accounting of expenditures.

The Parties agree that the CalAtlantic's payment of the SEP Amount to SFEI is a SEP, and that the SEP Amount will be treated as a permanently suspended administrative civil liability for purposes of this Stipulated Order. Xxxxxxxx 66’s CalAtlantic's SEP obligations will be satisfactorily completed upon the San Francisco Estuary Institute’s 's written notification to Regional Water Board staff and Xxxxxxxx 66the Discharger. The written notification shall acknowledge that the Regional Monitoring Program received payment of the SEP Amount from Xxxxxxxx 66 the Discharger and the payment will be spent on the project as described in Section III, paragraph 8(b) (i)9.b.i, and Exhibit B in accordance with the terms of this Stipulated Order. The San Francisco Estuary Institute’s 's annual and quarterly financial reports to the Regional Water Board shall be considered a final post-project accounting of expenditures.
