Service Provider Equipment. In relation to all equipment (including software): (a) used by the Service Provider or Resellers to connect to the LFC Network; or (b) provided to End Users by the Service Provider or Resellers, the Service Provider (in the case of Service Provider equipment (including software)): (c) is responsible for selecting, supplying and maintaining that equipment, and will ensure that each item of equipment meets applicable standards set out in the Operations Manuals; (d) will test that equipment to ensure that it will work in connection with the LFC Network; (e) will follow the LFC’s reasonable directions in relation to the connection of that equipment; and (f) will make any modifications to that equipment that the LFC reasonably requires to avoid any danger or interference that equipment may cause to the Wholesale Services, other network operators, Other Service Providers’ services, or the LFC Network, and in the case of Reseller equipment (including software), the Service Provider will procure that the Reseller carries out each of the obligations in clauses 3.4(c) to (f).

Service Provider Equipment. 24.1 All Service Provider Equipment installed within an Central Office must be electrically safe, meet standard EMC emissions requirements and be correctly earthed. The equipment will be required to comply with New Zealand electrical standards which can be found at xxx.xxxxxxxxx.xx.xx or xxx.xxxx.xxxx.xx, and EMI and RFI standards which can be found at xxx.xxx.xxxx.xx. 24.2 The Service Provider's racks and cabinets must be electrically isolated from the building (including any seismic bracing) to prevent electrical interference. An earth bar will be provided in every Co-location Service Area to which the earthing systems of each item of Service Provider Equipment must be connected. Any alarm lights or bells must be installed on the Service Provider's racks or cabinets.
Service Provider Equipment. For any Facility equipment manufactured by Service Provider or its Affiliates and delivered after the Effective Date, Service Provider agrees to provide a commercially reasonable equipment warranty as is customary in the nuclear industry, subject to prior agreement by Owners to the terms of such warranty, which will be set forth in the procurement documents applicable to such equipment. This warranty shall be subject to the limitations of liability in Sections 17.1(a) and 17.2.

Service Provider Equipment. 5.1 Subject to and conditioned on Customer's payment of Fees and compliance with all the terms and conditions of this Agreement, Service Provider shall provide to the Property the Service Provider Equipment. The Service Provider Equipment will at all times be owned by Service Provider and nothing in this Agreement operates to assign the ownership of the Service Provider Equipment to Customer. The parties agree, to the fullest extent permitted by law, the law in relation to fixtures does not apply to the Service Provider Equipment. 5.2 Customer shall promptly notify and provide a complete written report to Service Provider of any lost, damaged or stolen Service Provider Equipment or any accident involving the Service Provider Equipment that results in personal injury or property damage. Customer shall reimburse Service Provider for loss and expense incurred by Service Provider as a result of the damage, loss or theft of any Service Provider Equipment. For the avoidance of doubt, the provision of the Service Provider Equipment constitutes a one time capital investment made by the Service Provider for the purpose of fulfilling its obligations in this Agreement, and in no event shall the provision of the Service Provider Equipment be deemed to oblige the Service Provider to make any further capital investments under this Agreement, including without limitation, any replacement or upgrades of any out-dated equipment. 5.3 Customer shall be responsible for obtaining and maintaining any equipment and ancillary services needed to connect to, access or otherwise use the Service Provider Equipment and Services, including, without limitation, modems, hardware, servers, software, operating systems, networking, web servers and the like. Customer shall also be responsible for maintaining the security of the Service Provider Equipment, Customer account, and passwords (if any), and for all uses of Customer account or the Service Provider Equipment with or without Customer’s knowledge or consent. 5.4 Service Provider shall use reasonable efforts consistent with prevailing industry standards to maintain the Services in a manner which minimizes errors and interruptions in the Services. Services may be temporarily unavailable for scheduled maintenance or for unscheduled emergency maintenance, either by Service Provider or by third-party providers, or because of other causes beyond Service Provider’s reasonable control, but Service Provider shall use reasonable efforts to provi...

Service Provider Equipment. In the event that the Service Provider supplies the Equipment installed at the premises of Subscriber (in case the Subscriber does not purchase the Equipment), the Equipment shall be used in accordance with the Outlet Agreement stated below and shall remain the property of Service Provider and shall not be transferred, moved or removed from the place of its initial installation. Subscriber shall take proper care of the said Equipment and will not make any alterations or additions thereto. Subscriber shall be liable for any loss or damage to such Equipment installed and received in good order and condition. All Service Provider Equipment shall be returned to Service Provider upon termination of this Agreement or as may be required by Service Provider.
Service Provider Equipment. Service Provider or its underlying vendors may provide Customer Premise Equipment (“CPE”) as part of the Services. End User acknowledges that CPE may be removed or changed by Service Provider or its underlying vendors as required to provide service to End User. End User shall reasonably cooperate to provide access to such CPE as requested by Service Provider. End User shall not sell, transfer, lease, encumber or assign any part of the CPE. Further, End User shall not remove, attempt to repair or otherwise tamper with CPE, nor shall it permit others to do so. If any of the foregoing occur, End User shall have committed a material breach of the Agreement and shall be responsible for payment of service charges in the event maintenance, inspection, repair or replacement of the CPE is required. End User shall be responsible for fire, theft, or other casualty at End User’s locations. The boundary point of the service provider equipment means the inner side of the cabinet in terms of space, the power plug above the cabinet in terms of power, the upper connecting line of the user internet in terms of network.
