Service Terms and Conditions. (a) Shipper shall have a Firm Daily Variability Demand of GJ;
(b) During the period of September 15 to November 15 in the event that on any Day the Xxxx Quantity exceeds the Market Quantity by an amount greater than the Firm Daily Variability Demand (this amount shall be referred to as the “Excess”), Enbridge may, at its sole discretion, accept the Excess. In the event that the Excess is greater than zero, and Xxxxxxxx has not accepted such Excess in writing, Shipper shall pay Enbridge a charge equal to $3.00/GJ ($3.17/MMBtu) multiplied by the Excess. In addition, Enbridge may at its option, upon forty-eight (48) hours verbal notice to the Shipper (to be followed in writing), take title of such Excess which shall be immediately forfeited to Enbridge without further recourse;
(c) During the period of February 15 to April 15 in the event that on any Day the Market Quantity exceeds the Xxxx Quantity by an amount greater than the Firm Daily Variability Demand (this amount shall be referred to as the “Shortfall”), Enbridge may, at its sole discretion, accept the Shortfall. In the event that the Shortfall is greater than zero, and Enbridge has not accepted such Shortfall in writing, Shipper shall pay Enbridge a charge equal to $3.00/GJ ($3.17/MMBtu) multiplied by the Shortfall. In addition, Enbridge may upon forty-eight (48) hours verbal notice to the Shipper (to be followed in writing), replace all or part of the Shortfall at Xxxxxxx's expense;
(d) The Producer Balancing Account shall be limited to the following:
i. From November 1 to November 30 a cumulative credit position of up to GJ or a cumulative debit position of up to GJ;
ii. From December 1 to April 30, a cumulative credit position of up to GJ or a cumulative debit position of up to GJ;
iii. From May 1 to September 14, a cumulative credit position of up to GJ or a cumulative debit position of up to GJ;
iv. From September 15 to October 31, a cumulative credit position of up to GJ
v. In the event that this Contract is terminated, the balance in the Producer Balancing Account shall be zero (0) on the effective date of termination.

Subject to the terms and conditions of this LTA and the section 2 of the LNG Access Code, during the Contract Term, Terminal Operator shall provide Shipper with, and Shipper shall pay for, the LNG Services as Shipper may have subscribed pursuant to any Services Confirmation (attachment A of the LTA), for the relevant Service Term.
Service Terms and Conditions. This Waste & Disposal Services Agreement, consisting of the terms and conditions set forth herein, and entered into from and after the date hereof (all of the foregoing being collectively referred to as the “Agreement”), is made as of the Effective Date by and between the Customer named herein, whose signature is attached hereto, and who is referred to herein as (“the Customer”) and Tank’s Roll Off and Recycling /The Fairfax Companies referred to herein as (“the Company”).

DMRC and the Company agree that any maintenance and support services by DMRC with respect to the IDMarc Software, any customization services by DMRC related to the IDMarc Software, IDMarc Source Code and/or DMRC Digital Watermarking Platform, any other services by DMRC related to the IDMarc Software, IDMarc Source Code and/or DMRC Digital Watermarking Platform (other than the training and technical assistance to be provided by DMRC to the Company pursuant to Section 2.2(c) above), and any research, development, engineering, quality assurance, preparing, obtaining and maintaining jointly owned patents, project management, reporting, and such other services or activities as the parties may mutually agree shall be provided by DMRC in accordance with this Agreement and the Service Terms and Conditions attached hereto as Schedule I (“Service Terms and Conditions”).

In case, during the Services the Company identifies that it is impossible to deliver the Services within the agreed time, the Company shall immediately notify GWP about such inability and take all measures to agree a new deadline. Services dates and times which have been agreed to by both parties which are later cancelled or rescheduled at Client’s request will result in: (i) Client shall reimburse Interneuronfor expenses incurred prior to the cancellation or rescheduling notice being received, and (ii) if Interneuron is notified less than twenty (20) business days before the scheduled date, forfeiture by Client of the service hours which Interneuron is unable to re-book with another client for the same dateand time (Client will pay Interneuron for said hours if they haven’t already done so). Any Services listedon the associated Order Form must be used by Client prior to the one year anniversary of the Effective Date. Any Services unused by Client as of that time shall expire. Unused services cannotbe transferred to other engagements.
Service Terms and Conditions. These Service Terms & Conditions provide the agreed conditions of the Customer utilising the PTLGateway System and Managed Services. These Service Terms & Conditions apply solely to the Services and are governed by the PTLGateway MSA. Volvo may modify, upgrade, exchange or substitute any of the Information Services or part thereof without notice as part of the continuous improvement process related to the Information System or as required to comply with any applicable safety, statutory or regulatory requirement or for added functionality which does not materially affect the quality or performance of the Information Services or of the vehicle. The right of the Customer to use the Information Systems is subject to the technical and regulatory availability of the Information Systems. The technical availability of the Information Systems depends on availability of network and satellite coverage and may be disrupted due to local barriers (including but not limited to bridges, buildings and other physical barriers), atmospheric or topographic conditions and technical limitations (including but not limited to inbuilt errors of any GPS system). Volvo disclaims any guarantee or liability for the security of the mobile telecommunications, wireless or other network used for the transmission of Vehicle Data and other information. The Information Systems may not be available due to maintenance work. Details of planned maintenance work will, if possible, be posted on the Digital Channels or otherwise communicated to the Customer. The Client agrees that the Company’s services should be used by people with specific knowledge and experience in the field of financial markets, and who are able, while making deals, to estimate the risk and profit levels without relying on the data provided on xxx.xxxxxxxx.xxx.
3.2. The Client should take into consideration the fact that Forex and CFD trading might be considered illegal in some countries. The Company does not give any legal advice regarding the matter of legality of its services within the country of the Client’s residence. The Company may refuse to provide its services to Clients from countries that consider them as illegal. However, its website will still be available. In this context, it should be stressed out, that if the Client resides or is present in a jurisdiction that prohibits the use of the services offered on the website, the Client shall not participate in the prohibited activity. The Company might not target specific jurisdictions, but it offers services on a cross - border basis, while not having ‘physical presence’ and following a ‘reverse enquiry’.
