Service to Multiple Dwelling Units. Consistent with this Section 12.1, the Grantee shall offer the individual units of a Multiple Dwelling Unit all Cable Services offered to other Dwelling Units in the Town and shall individually wire units upon request of the property owner or renter who has been given written authorization by the owner; provided, however, that any such offering is conditioned upon the Grantee having legal access to said unit in the form of an access and wiring agreement that is mutually satisfactory to the Grantee and the property owner. The Town acknowledges that the Grantee cannot control the dissemination of particular Cable Services beyond the point of demarcation at a Multiple Dwelling Unit.

Service to Multiple Dwelling Units. Consistent with this Section 12.1, the Grantee shall provide Cable Service to Multiple Dwelling Units in accordance with an agreement with the property owner or owners, this Franchise and all applicable laws.

Comcast and the Township hereto acknowledge and agree that installation and provision of Cable Service to Multi-Dwelling Units (“MDU’s”) are subject to a separate negotiation between the landlord, owner or governing body of any such MDU and Comcast, which negotiations shall be conducted in accordance with the procedures set forth in the Cable Act, applicable FCC regulations, the Pennsylvania Landlord-Tenant Act, as amended, and the applicable provisions of 68 P.S. § 250.501-B et seq.

Time Warner Cable and the Township hereto acknowledge and agree that installation and provision of Cable Service to multiple dwelling units (MDU’s) are subject to a separate negotiation between the landlord, owner or governing body of any such MDU and Time Warner Cable, which negotiations shall, when applicable, be conducted in accordance with the procedures set forth in the Communications Act of 1934, as amended, applicable FCC regulations, the Landlord Tenant Act of 1951, as amended and the applicable provisions of the Tenant’s Right to Cable Act, 68 P.S. §§ 250.501-B et seq.
